Palermo Law Group worked tirelessly to obtain a $800,000 recovery on behalf of the estate of a woman who died from a brain bleed after falling on defective stairs and sustaining head trauma.

PLG hired an architect to investigate the stairs. He determined that there were numerous defects and building code violations pertaining to the stairs.

However, the fall was unwitnessed and the victim’s death precluded her from testifying about what happened. The challenge was proving that the defects in the construction of the stairs were a cause of her fall.

Fortunately, we were able to secure her “present sense impression” of the occurrence when she called her employer shortly after the fall. This combined with statements contained in the victim’s medical records provided exceptions to the hearsay rule that carried the day.

Another key takeaway is the critical importance of seeking immediate medical attention following head trauma. Many people feel OK after head trauma but are unknowingly dealing with a ticking time bomb known as subarachnoid hemorrhage, or brain bleed. Pressure slowly builds around the brain until a potentially fatal condition occurs.

CT scans taken soon after the trauma are effective in revealing the bleed. Immediate medical intervention to relieve pressure once the bleed is diagnosed is likewise highly effective in saving lives.

This is also why it’s important to wear helmets when engaging in activities such as biking or skiing where head trauma is foreseeable.

Many accident victims can have a lengthy and painful road to recovery with overwhelming medical expenses, loss of wages, and/or permanent disfigurement and disability.

🚲⚡ NEW ILLINOIS E-BIKE & E-SCOOTER RULES ARE COMING — AND PARENTS NEED TO KNOW THE AGE LIMITS

E-bikes and electric scooters are everywhere these days—on neighborhood streets, bike paths and around schools. But beginning January 1, 2027, Illinois is changing the rules governing who can ride them and where they can be used.

One of the biggest changes involves kids and teenagers.

Here’s the quick breakdown for Illinois parents:

🔹 UNDER AGE 15:
Children under 15 cannot operate a Class 1, Class 2 or Class 3 e-bike. They also cannot operate covered electric scooters or other electric micromobility devices.

Traditional, non-electric bicycles are still allowed.

🔹 AGE 15:
May operate Class 1 and Class 2 e-bikes, which provide motor assistance up to 20 mph.

A Class 1 e-bike provides assistance only while the rider is pedaling. A Class 2 can use a throttle to propel the bike without pedaling.

🔹 AGE 16+:
May operate Class 1, Class 2 and Class 3 e-bikes. Class 3 bikes can provide pedal assistance at speeds up to 28 mph.

Riders must also be at least 16 to operate covered electric scooters, electric skateboards, electric unicycles and similar electric micromobility devices.

⚠️ WHAT ABOUT THOSE REALLY FAST “E-BIKES” AND E-MOTOS?

This is where parents need to be particularly careful.

Just because a manufacturer or retailer calls something an “e-bike” doesn’t necessarily mean Illinois law treats it as a bicycle.

Some higher-powered electric bikes and e-motos fall outside Illinois’ Class 1, 2 and 3 low-speed e-bike definitions and may instead be regulated as motor-driven cycles. Depending on the device’s motor power and capabilities, a driver’s license, title, registration and insurance may be required.

Before buying one for your child, check the motor wattage, maximum assisted speed and e-bike classification—not just the product description.

🚫 AND NO—THE SIDEWALK ISN’T THE SOLUTION.

Under the new law, low-speed e-bikes and covered electric micromobility devices such as e-scooters cannot be operated on sidewalks.

Local governments, park districts, forest preserve districts and other authorities may also regulate where these devices can be used on paths and trails.

👶 WHAT CAN YOUNGER KIDS RIDE?

Kids under 15 can, of course, continue riding traditional bicycles.

The law also recognizes a separate category of small battery-powered “toy vehicles” designed for children under age 8 that don’t exceed 10 mph. These are treated differently from e-bikes and e-scooters and may be used on sidewalks and bicycle paths, although local authorities can prohibit them in certain areas.

THE TAKEAWAY FOR PARENTS:

Before buying your child an e-bike, e-scooter or e-moto, don’t assume it’s legal for them simply because it’s marketed to kids or available online.

Check the age requirement. Check the class. Check the wattage. Check the maximum speed. And check where your child can legally ride it.

These new Illinois rules take effect January 1, 2027.

And as more e-bikes and scooters share our roads, drivers have a responsibility too: slow down, watch for riders and safely share the road.

How injured do you need to be before calling a personal injury attorney?

There’s no perfect answer, but here’s a good rule of thumb: if the injury is affecting your life for more than just a few days, it’s worth having the conversation.

Most people have no idea they’re making these mistakes after a car accident—and unfortunately, insurance companies know it.

🚩 Three things an insurance adjuster hopes you do:

1️⃣ Give a recorded statement immediately.
You may think you’re simply telling your side of the story, but once it’s recorded, your words can be used later to minimize or dispute your claim.

Instead: Be polite, gather the adjuster’s contact information, and understand your rights before providing a recorded statement to the other driver’s insurance company.

2️⃣ Say, “I’m fine.”
After an accident, your adrenaline is working overtime. It’s common to feel okay at first, only to develop neck pain, headaches, or other injuries hours—or even days—later.

Instead: If you’re unsure how you’re feeling, it’s okay to say, “I’m still being evaluated and don’t know the full extent of my injuries yet.” Then pay attention to your symptoms over the next several days.

3️⃣ Wait to get medical care.
Delaying treatment can make it harder to connect your injuries to the crash, and more importantly, it can delay the care you need.

Instead: If you’re experiencing pain or discomfort, get evaluated by a qualified medical professional as soon as possible. Follow your provider’s recommendations and keep records of your appointments and treatment.

✅ After any accident, here’s what you should do:
• Check for injuries and call 911 if needed.
• Move to a safe location if it’s possible to do so.
• Call the police and request an accident report.
• Exchange insurance and contact information with the other driver.
• Take photos and videos of the vehicles, the scene, road conditions, and any visible injuries.
• Collect witness names and phone numbers if anyone saw what happened.
• Notify your insurance company promptly.
