Feerick Nugent MacCartney successfully defended the Town of Fishkill against a 1.2 million dollar breach of contract claim brought by a developer against the Town.

Today, New York State's highest court (the Court of Appeals) issued a decision affirming the dismissal of the developer's Complaint and confirming that under New York State law, development agreements that bind successor municipal boards on matters of governance (zoning amendments in this case) are unenforceable.

Partner Brian D. Nugent argued the case before the Court of Appeals on November 20, 2025.

NY EMPLOYERS: New York Labor Law § 194-b goes into effect on September 17, 2023 and requires employers with 4 or more employees who advertise an employment position, promotion or transfer to disclose:

(i) the compensation or a range of compensation for such job, promotion, or transfer opportunity; and

(ii) the job description for such job, promotion, or transfer opportunity, if such description exists.

If a position is paid on commission, that must be indicated in order to satisfy the requirement.

Feerick Nugent MacCartney was successful on a recent appeal to New York State’s highest court - the New York State Court of Appeals. The May 23, 2023 decision of the Court of Appeals reverses an earlier decision of the Appellate Decision and now confirms that exempt class civil service employees (employees that are not required to take an exam or demonstrate qualifications) are at-will employees and cannot obtain job protection under a union contract. Brian D. Nugent argued the case, assisted by Attorneys Matt Lizotte, Alak Shah and Don Feerick of the firm.
