DHS Terminates the 2023 Designation of Venezuela for Temporary Protected Status

After reviewing country conditions and consulting with the appropriate U.S. government agencies, Secretary of Homeland Security Kristi Noem has determined that conditions in Venezuela no longer support the 2023 designation of Venezuela for Temporary Protected Status (TPS).

TPS and related benefits associated with the 2023 designation will no longer be in effect starting 60 days after publication of the Federal Register notice.

For DACA holders, also known as Dreamers, traveling can be a risky proposition due to their immigration status. DACA, or Deferred Action for Childhood Arrivals, provides temporary protection from deportation and allows eligible individuals who were brought to the United States as children to obtain work permits and pursue education. However, DACA does not provide a pathway to citizenship or legal permanent residency.

Traveling outside the United States as a DACA recipient carries significant risks. If a DACA recipient leaves the country, they may not be allowed to re-enter, as DACA does not guarantee re-entry. This is because DACA recipients are considered to be unlawfully present in the United States, and leaving the country could trigger a bar from re-entering for a certain period of time, typically three or ten years, depending on how long they were unlawfully present before receiving DACA.

There have been instances where DACA recipients who left the country for humanitarian reasons or under special circumstances were not allowed back into the United States, despite having valid DACA status. Therefore, DACA recipients are generally advised against traveling outside the country unless absolutely necessary and after consulting with an immigration attorney.

Additionally, the political and legal landscape surrounding DACA is subject to change, which can further complicate matters for DACA recipients. Changes in government policy or court rulings could impact DACA eligibility, renewals, and travel permissions.

Overall, traveling as a DACA recipient involves significant risks and should be approached with caution and careful consideration of the potential consequences.
