Something I want every Michigan driver to understand: field sobriety tests are not as reliable as most people (or most jurors) think.

I know this because for years I was on the prosecution side using them. The Walk and Turn, One-Leg Stand, and Horizontal Gaze Nystagmus tests can be affected by medical conditions, road surface, lighting, nerves, and the subjective judgment of the officer administering them.

Question I get all the time: should you refuse the breathalyzer if you get pulled over?

In Michigan, refusing a breathalyzer triggers automatic license suspension under implied consent law. In my years as a prosecutor, I also watched that refusal get used as evidence against defendants in court.
