Bu yayından ülkenizdeki koşullara dair Amerika’nın tutumuna bakabilirsiniz. Bu yayında aşağıdaki konularla sınırlı olmamak üzere bu ve benzeri maddeler incelenmektedir.
a. Siyasi baskı
b. Farklı gruplara ait olan insanlar üzerinde uygulanan baski, örnek olarak LGBTQ kominitesine ait olan insanlar üzerindeki baskı
c. Dini baskı
d. Irk, milliyet ve etnik köken nedeniyle olan baskı
Iltica başvurusu mülakatını yapan memur veya hakim sizin başvurunuzu Amerikan Dışişleri Bakanlıgı tarafından yayınlanan bilgiler ışıgında inceleyecektir.
2. Kişisel Iltica Beyanı
Ilticanizin kabul edilmesin de kilit rolü sizin hazırlayacagınız kişisel beyanınız oynayacaktır. Öncelikli olarak ülkenizdeki durumu resmenden olaylara odaklanin. Sizin başvurunuzu inceleyecek USCIS görevlisinin veya hakimin vaktine saygı duyun. Direk olarak meseleye gelmeye çalışın.
3. Tanıklar ve Kaynaklar
a. Amerika’daki veya başka bir ülkedeki tanıklardan yazılı ifade alın.
b. Amerika’daki veya baska ülkelerdeki üniversite hocalarini ve gazetecelileri uzman bilirkişi olarak kullanın. Firmamiz sizin kişisel beyanınızı değerlendirmesi icin bir çok ülkeden kişiler ile bilirkişi hizmeti saglamaktadir.
4. Avukatın Mülakat Öncesi Yazılı Özeti
Firmamızın avukatları iltica analisti veya hakim için sizin iltica başvurunuzun önemli noktalarını içeren yazılı bir özet hazırlamaktadır. Bu hukuki özet metni, önemli gercekleri özetleyecek ve olayları ülke koşulları, hukuk ve tanık beyanları ile entegre eden bir girizgah görevi görecektir. Bu özet metni genelde basvurunuz ile beraber veya mülakat/mahkeme tarihinizden 15 gün icinde gönderilir.
5. Avukatın Mülakat Sonrasi Yazılı Özeti
Avukatlarimiz, iltica mülakatina katılır ve mülakata dair bir nihai belge hazırlarlar. Bu nihai belge, mülakat analisitinin başvurunuzun önemli noktalarını hatırlamasını sağlamak amacını taşımaktadır. Genelde, bu nihai belge sürecin başında gönderdiğimiz belge ile aynı amacı taşımaktadır.
6. Mülakata Hazırlık
Sorulan soruları dikkatli bir şekilde dinlemeniz ve sadece sorulan sorulara cevap vermeniz önem taşımaktadır. Iyi hazırlık yapan müvekkilerimizin sorulan soruları iyi anladığını gözlemliyoruz. Genelde, başınızdan geçen her şeyi, bütün hikayenizi, anlatmanız istenmeyecektir. Bütün hikayenizi anlatmaya calışmanız bir hata olacak ve mülakatınızın kötü geçmesine sebep olacaktır.

On an average, our attorneys file in excess of three hundred H-1B visa petitions annually, with clients ranging from fortune 500 to small businesses. This year, approximately 74% of the H-1B petitions were approved immediately, without any additional “Requests for Evidence” by USCIS. Ultimately, less than 1% of H-1B cases were denied. Attached is a copy of an approval issued a few days ago on a rather difficult case, where an agency and not an employer petitioned for a specialist from Ukraine. The visa was granted for 3-years. Due to Trump’s temporary ban on H-1B entries, this employee will enter in January 2021. Additionally, we handle many cases where H-1B employees find new jobs and switch employers or where employer’s sponsor their H-1B and other employees for Permanent Residency.

Judge Blocks USCIS Fee Increases: Here’s Why It Happened

A federal judge granted a motion for a preliminary injunction against a far-reaching U.S. Citizenship and Immigration Services (USCIS) fee rule. The rule would increase fees on businesses, new citizens, international students needing work authorization and others. The fees were scheduled to go into effect on October 2, 2020.

The court ruling deals a blow to Trump administration plans to restrict immigration and naturalization by raising fees.

Fiance/Spouse (family) Visas

K-1 Fiancee Visa
A K-1 fiance visa is a nonimmigrant visa benefiting fiancées of U.S. citizen petitioners. It permits the foreign national fiancee of a U.S. citizen to enter the United States for a ninety (90) day period to conclude a marriage with the U.S. citizen petitioner. The marriage must take place within the ninety (90) day period after entry. After the marriage occurs, an application for permanent residence can be made for the foreign national.

The petitioner of the K-1 fiance visa petition must be a U.S. citizen. The parties must have met in person within the two (2) year period prior to filing the petition; however, a waiver of this requirement may be granted in certain cases. The parties also must provide proof that they have a bona fide intention to marry within ninety (90) days of the fiancee entry into the United States and that there are no legal impediments to marriage.

Unmarried children of the K-1 beneficiary may accompany the K-1 fiance visa beneficiary to the United States on a K-2 visa. Children in K-2 visa status may attend school and, after the marriage of the K-1 parent to the U.S. citizen petitioner, may apply for employment authorization.

K-3 Spouse Visa
A K-3 spouse visa is a nonimmigrant visa benefiting foreign-citizen spouses of U.S. citizens, but because of current visa processing lags has limited benefit. The K-3 spouse visa permits the spouse of a U.S. citizen who has filed an I-130 Petition to enter the United States to await approval of the petition. Proof of the filing of the I-130 Petition must be included with the K-3 spouse visa petition. Unmarried children of the K-3 beneficiary may accompany the K-3 beneficiary to the United States on a K-4 visa.
