False Claims Act Litigation

Michael Rosenblat is an experienced trial lawyer representing whistleblowers under the Federal False Claims Act and related statutes. He was the lead prosecuting attorney for Illinois’ Medicaid Fraud Control Unit and represented the State of Illinois as part of a global settlement team against Walgreens for violating the False Claims Act by “short-fillin

g” prescriptions. Rosenblat is the co-author of the Illinois Institute of Continuing Legal Education, Employment Termination, “Prosecuting a Claim Under the Illinois False Claims Act.” He has spoken before groups concerning false claims issues, criminal defense, and search and seizure; appeared on the local cable show "Newsmakers" to discuss prescription drug pricing; appeared on "Fox News Live" to discuss the Michael Jackson trial, was a guest on the WLS Radio Rohm and Roeper Show to speak about the Rod Blagojevich trial; has appeared on CNN’s Anderson Cooper 360, has been quoted in the Wall Street Journal concerning Medicare fraud, and in the Chicago Lawyer Magazine concerning the false claims act case filed by Floyd Landis against Tour de France winner Lance Armstrong. Rosenblat has represented Relators or qui tam plaintiffs in conjunction with other law firms from Texas to New York. He is sought after by other law firms to act as their local counsel because of his experience in filing False Claims Act cases in the Northern District of Illinois. His legal analysis, of a case declined by the United States and Illinois, led to the successful representation of a whistleblower who was unable to find an attorney to represent him until Mr. This case ultimately resulted in a $225 million settlement. Rosenblat works closely with other law firms to ensure that his clients get the best representation possible in their False Claims Act cases. In doing so, Mr. Rosenblat demonstrates his willingness to put his clients first by willingly co-counseling with other lawyers whenever that may help advance the prosecution of a False Claims Act case. Rosenblat has successfully represented whistleblowers in, United States, ex rel. Perez v. Stericycle, United States, ex rel. Kennedy v. Aventis, United States ex rel. Tyson v. Amerigroup, and the State of Illinois in United States, ex rel. Mueller, et al v. Walgreens. As Deputy Chief of the Medicaid Fraud Control Unit of the Illinois Attorney General’s Office located in Chicago, Mr. Rosenblat was a member of the global settlement team in which Walgreens agreed to pay $7.6 million to settle a false claims case alleging that Walgreens, which is headquartered in Deerfield, Illinois overcharged states and the federal government for prescription drugs. As Deputy Chief Criminal Prosecutions, he supervised the assistants assigned to that bureau and as Deputy Bureau Chief, Special Litigation Bureau, he prosecuted false claims cases on behalf of the State of Illinois. In private practice, Mr. Rosenblat represented consumers in the Ford/Firestone Tire Litigation, Superior Bank underinsured depositors litigation, and Enron Securities Litigation. Rosenblat was also part of the prosecution team that obtained a $334 million judgment against Amerigroup. Amerigroup settled for $225 million. Rosenblat also represented the whistleblowers in another declined False Claims Act case filed in Chicago, concerning the off-label marketing of a prescription drug. This case also settled with a favorable result. Currently the Rosenblat Law Firm has a number of false claims act cases pending and or under seal and is currently assisting in the prosecution of Stericycle a medical waste disposal company located in Lake Forest, Illinois. “Today we resolve a question about the State’s responsibility to honor the agreements it makes with defendants. Specifically, we address whether a dismissal of a case by nolle prosequi allows the State to bring a second prosecution when the dismissal was entered as part of an agreement with the defendant and the defendant has performed his part of the bargain. We hold that a second prosecution under these circumstances is a due process violation, and we therefore reverse defendant’s conviction,” the Illinois Supreme Court wrote in its ruling.
