We're looking for an experienced immigration attorney to take real ownership of a caseload. This isn't a role where you work the files you're handed. You'd shape how cases get screened, prioritized, and run.

Your base pay lands every two weeks, regardless of case volume that month. On top of that, there's a KPI bonus tied to metrics we agree on together... not volume over quality.

What you'd own:

Your employer's layoffs could now show up in your H-1B case.

On September 18, 2026, the White House signed a new executive order titled "Enhancing Program Integrity and Interagency Coordination in the Administration of the H-1B Nonimmigrant Visa Program."

Here's what it actually does.

DHS, the Department of Labor, and the State Department are now directed to consider whether your sponsoring employer laid off workers, directly or indirectly, in the past 12 months. Or whether they're planning layoffs that would affect "similarly situated" U.S. workers.

This applies at every stage of the H-1B process... the Labor Condition Application, the H-1B petition itself, the visa application, and even entry into the U.S.

There's more. Within 30 days, the Department of Labor's Wage and Hour Division has to start reviewing previously filed LCAs to decide if enforcement action is warranted. That means employers could face scrutiny on cases that were already approved.

What this does not do... it does not ban an employer with a layoff history from sponsoring H-1B workers. There's no automatic disqualification and no formal labor market test written into the order. Layoffs become one factor agencies weigh, not an automatic denial.

The catch is that the agencies haven't issued the actual implementation guidance yet. So exactly how "similarly situated" gets defined, and how heavily this gets weighed, is still unknown.

If your employer has gone through layoffs or restructuring this year, this is worth understanding before your next filing... not after.
