The 75-country visa suspension has been lifted! But what does that REALLY mean for applicants? 👀🇺🇸

If your visa application was previously refused under Section 221(g), this is a conversation you want to pay attention to.

The good news? Affected cases are being reviewed. The reality? That doesn’t automatically mean your visa will be approved.

Some applicants may be asked to attend another interview, submit updated documents, or take additional steps before a decision is made.

Government benefits = no green card? 👀 Not exactly.

Effective September 18, 2026, USCIS introduced changes to the Adjustment of Status application, including expanded questions related to the public charge assessment.

First, an important distinction: the public charge assessment is about the person applying for the immigration benefit. It is not automatically about benefits received by your U.S. citizen children, your petitioner, or other household members.

USCIS looks at the totality of the applicant’s circumstances rather than deciding the case based on one factor alone. The updated form asks more detailed questions about household circumstances, education, skills, and certain means-tested benefits.

And receiving a government benefit does not automatically mean your green card will be denied. The type of benefit, who received it, and the applicant’s overall circumstances matter.

So before you panic because your child receives WIC, your household receives assistance, or you’ve heard that “government benefits mean no green card”, understand who USCIS is assessing and what actually counts.

A federal judge in Massachusetts has POSTPONED a DHS rule that was set to take effect September 15 and would have ended the longstanding “duration of status” framework for international students and certain other visa holders.

In issuing the order, the court described DHS’s justification as “exceptionally weak” and raised serious concerns about the potentially catastrophic impact of the rule on higher education and the U.S. economy.

For now, duration of status remains in effect. Nothing changes on September 15.

The lawsuit will continue, and DHS may still appeal. We will continue monitoring the case and provide updates as they develop.
