A Federal Judge granted our Habeas Corpus petition, finding that our client's detention under § 1225(b)(2) was unlawful. As a result, the court ordered an individualized bond hearing within 10 days. At that hearing, bond was set and our client's freedom was restored.
Habeas Corpus is one of the most powerful legal tools available to individuals who are being held without a lawful basis. When the government detains someone without providing them an opportunity to be heard before a neutral judge, it violates the most fundamental principles of American due process — regardless of that person's immigration status.
Mandatory detention under § 1225(b)(2) has been applied broadly to immigrants, often keeping people locked up for months or even years without any individualized review of whether detention is even necessary. This ruling is a reminder that those detentions can — and should — be challenged.
