Meet David Kerr, a Utah attorney focusing on estate planning, asset protection, and business planning. David brings over a decade of legal experience to his work helping individuals, families, and business owners protect assets, preserve legacies, and plan for the future with confidence.

Before joining Allies Law Firm, David served as General Counsel to a private investment group, managing legal matters for more than two dozen affiliated entities. His work included advising on deal structures, drafting and negotiating complex contracts, and designing governance frameworks to support long-term operations. That experience continues to inform his estate planning practice and his approach to drafting trusts and planning documents.

David earned his law degree from J. Reuben Clark Law School and a bachelor’s degree in civil engineering, both from Brigham Young University. He is an active member of the Utah State Bar’s Estate Planning Section and Business Law Section.

⚖️ Legal Tip Tuesday: Burden of Proof Explained Simply

What does “burden of proof” actually mean?

Simply put, the burden of proof is the legal responsibility to prove a claim is true using evidence. But who has to prove what? Let’s break it down:

1️⃣ Who has the burden first?
Generally, the person making a claim has the responsibility to present evidence supporting that claim first.

2️⃣ Can the burden shift?
Yes. Once enough evidence is presented on an issue, the other party may need to respond with evidence supporting their position.

3️⃣ What is the standard of proof?
The standard depends on the type of case:
🔹 Criminal cases: The prosecution must prove guilt beyond a reasonable doubt.
🔹 Civil cases: The standard is generally preponderance of the evidence, meaning the claim is more likely than not to be true.

4️⃣ Why does it matter?
A court doesn't decide a case simply by asking, “Who's telling the truth?” It also considers:
“Who is required to prove it, and did they provide enough evidence to meet the required standard?”

Understanding legal terms can make the legal process a little easier to navigate. And when you're facing a legal matter, having someone who can explain what the process means for your specific situation can make all the difference.

A native of Cache Valley, Jase attended Logan High School before earning his degree with honors in finance and economics from Utah State University. He went on to attend the University of Nebraska College of Law, where he studied wills, trusts, and estate planning. Jase is also an attorney-member of the Utah State Bar’s Estate Planning Section.

Estate planning is more than just documents—it’s about understanding what matters to you and making sure your wishes are carried out. Jase brings a unique perspective to this work as a third-generation funeral home professional in his family business, Allen-Hall Mortuary. His experience in the funeral industry has given him a firsthand understanding of the importance of having your affairs in order through proper planning.

Before founding Allies Law Firm, Jase worked as an associate attorney at firms in Salt Lake City and Logan.
