Georgia now allows a Transfer on Death deed, a tool that lets you name who gets your home when you pass without going through probate, but it is not a one size fits all solution. It is a narrow option with strict rules, including the requirement that an affidavit of survivorship must be filed within nine months or the property can still end up in probate.
The TOD Deed also does nothing for incapacity planning, so if something happens during your lifetime, it offers no protection or control. Before relying on a TOD deed, make sure it actually fits your goals and does not create more problems for your family later.
