Summer break is around the corner...

Now is a good time to check whether or not your custody agreement reflects your children’s changing needs

If it doesn’t, it may be time to consider a modification of your parenting plan!

Important things to think about include:

☀️ What plans to you have for your children this Summer? Will they be going away to camp? Doing a mix of sleep away camp, day camp and family travel?

☀️ What Summer activities do the children participate in, and what transportation is needed?

☀️ How are these activities/sports expenses paid for?

All of these factors affect what type of parenting plan is necessary, ans what may have worked for your family last Summer may not this year.

If the parenting schedule needs to be adjusted, then the current child support order, and any order for payment for activities may need to be adjusted, too.

If the plan does not meet these needs, then you need to modify the plan, whether by filing a joint agreement or by filing a Complaint for Modification.

For a successful Complaint for Modification, you must be able to show a clear and substantial change in circumstances from the date of the last agreement, and that the changes requested are in your child’s best interests.

🎓 You now have a high school graduate! So what comes after the cap and gown?

Graduating from high school is a significant milestone for both parents and their child.

It also signals another really important milestone that happens either just before, close in time with or right after this rite of passage – reaching age 18!

They will now be considered an adult, which means as a parent you may no longer be able to make health care decisions or access their financial accounts and records just by stating that you are their parent.

Graduation season is a great time to put important Estate Planning documents in place for your new, young adult including:

✨️ Durable Power of Attorney (DPOA)
✨️ Health Care Proxy (HCP) in place to name someone as their “in case of emergency” designee(s) for financial/legal matters (DPOA) and health care matters (HCP).

Considering co-buying a house with someone 🏠?

Whether you're buying a home with a significant other, family member or friend, you need to have all of our bases covered for the future.

🏡 A co-ownership agreement is important to protect your new home!

It answers questions such as who would stay in the property in the event of a breakup, how the equity and title to the property will be divided if one person moves out, and what happens to shared property if either party passes away.

It is a contract where you both agree to the terms and conditions:

• What happens to the house if you split up or one of you predeceases the other?

• Do you sell the property and split the proceeds 50/50?

• Who, for instance, is your healthcare proxy?

You should specify in that agreement that you both get back what you invested in the home.

A co-ownership agreement allows you to think these decisions through up front when you’re getting along well so you can make a plan for what will happen if something goes wrong.

Who has access to mobile devices, cloud accounts and other digital assets in the event of your death or disability?

Whether it is photos, movies, music, credit card points, e-mail accounts, domain names, on-line banking accounts, or bitcoins, these should all be inventoried and considered as part of your estate plan.

Many of these sites may have user agreements that protect customer privacy and prevent others from accessing them upon incapacity or death so it is important to designate an agent for your digital assets along with leaving instructions on how to access them.

"I put $200K toward a down payment for a condo unit with my boyfriend. He is on the title, but not on the mortgage. How do I protect my equity investment now?"

🏠 This is a common situation that homeowners can find themselves in!

Whether you're buying a home with a significant other, family member or friend, you need to have all of our bases covered for the future...

In this scenario, if the boyfriend on the title, he should be on the mortgage. It creates an imbalance of power within the property ownership agreement.

If the relationship with this man sours, and he walks away, you would be left to make the payments to avoid losing the home and damaging your credit rating, not him.

What’s more, if you pay the mortgage off, he will still be entitled to his 50% share of the property should you sell it!

What's the solution?

Less than one third of us have a plan in place...

According to a 2024 Survey on estate planning in the US by Caring.com, in association with You.gov.

✨️ The encouraging news is the percentage of the population of 18-35 year olds with a plan in place continues to grow – 50% increase since 2020.

✨️ The discouraging news is for the rest of us, now fewer than 1/3 of people have a plan in place – 32%.

It’s also fundamentally for the same reasons – “I don’t have enough assets,” or “I’ll get to it when I have a health crisis.”

Both those reasons misunderstand the point of an estate plan and in some cases cause us to forgo being able to create one.
