We regularly help clients who have purchased real estate foreclosed upon by municipalities because of unpaid property taxes. While these usually seem like a great value, all buyers need to understand that they will be receiving a "Quit Claim" deed from the municipality. This means that the town is simply transferring whatever rights of ownership it has (or may not have!) in the property. When a property is taken for unpaid property taxes, there is a very clear statutory process that MUST have been followed or else the foreclosure process was invalid. Before a subsequent buyer of a tax foreclosed property can get title insurance or a mortgage loan, they will need to get "marketable title." Sometimes, the only way to do this is to file a suit for a declaratory judgment in court and prove that the town followed all of the requirements of the tax lien foreclosure statute. Buyers beware, and be sure to do your research before snapping up that "bargain!" If you find yourself in this situation, give us a call- we have several creative ways of helping you clear your real estate title.
