⚖ DĂ©cision favorable obtenue devant le Tribunal administratif de Cergy-Pontoise

Notre cabinet a rĂ©cemment saisi le juge des rĂ©fĂ©rĂ©s sur le fondement de l’article L. 521-3 du Code de justice administrative pour une cliente qui attendait depuis septembre 2025 l’enregistrement de sa demande d’admission exceptionnelle au sĂ©jour.

La prĂ©fecture du Val-d’Oise lui avait fixĂ© un rendez-vous au 9 mars 2027, soit environ 18 mois aprĂšs sa demande.

Dans son ordonnance du 13 aoĂ»t 2026, le Tribunal a reconnu l’urgence de la situation, notamment en raison du risque de perte de son emploi.

Le juge a ainsi ordonnĂ© au prĂ©fet du Val-d’Oise :

✅ de convoquer la requĂ©rante en prĂ©fecture dans un dĂ©lai de 15 jours ;
✅ de lui permettre d’enregistrer sa demande d’admission exceptionnelle au sĂ©jour ;
✅ de lui dĂ©livrer un rĂ©cĂ©pissĂ©, sous rĂ©serve de la complĂ©tude de son dossier.
L’État a Ă©galement Ă©tĂ© condamnĂ© Ă  lui verser 500 euros au titre des frais de procĂ©dure.

Cette dĂ©cision rappelle qu’un dĂ©lai excessif pour accĂ©der Ă  un rendez-vous en prĂ©fecture peut ĂȘtre contestĂ© lorsque le demandeur dĂ©montre l’urgence et l’utilitĂ© de la mesure sollicitĂ©e.

Nous sommes heureux d’avoir obtenu cette dĂ©cision pour notre cliente et de lui permettre de faire avancer une situation administrative bloquĂ©e depuis prĂšs d’un an.

Chaque situation reste toutefois particuliĂšre et doit faire l’objet d’une analyse individualisĂ©e.

Le ministĂšre de l’IntĂ©rieur vient de trancher : tĂ©lĂ©travailler depuis la France pour un employeur Ă©tranger ne constitue pas une « activitĂ© professionnelle » interdite par la carte de sĂ©jour « visiteur » — tant que vous ne travaillez pas pour une entreprise installĂ©e en France.
