We are pleased to share two significant EB-1 successes recently obtained for our clients:

• An EB-1A Extraordinary Ability petition approved after reopening; and
• An EB-1C-based adjustment of status approved for a multinational executive or manager.

The EB-1A matter presented a particularly important legal challenge. USCIS determined that the required evidentiary criteria had been satisfied but nevertheless denied the petition at the “final merits” stage.

Client challenged that decision, relying in part on the reasoning of Mukherji v. Miller. USCIS subsequently reopened the matter and approved the EB-1A petition. This result is an important reminder that a denial is not necessarily the end of the case. Careful legal analysis, persistence, and a well-supported challenge can make a decisive difference.

⚖️ Décision favorable obtenue devant le Tribunal administratif de Cergy-Pontoise

Notre cabinet a récemment saisi le juge des référés sur le fondement de l’article L. 521-3 du Code de justice administrative pour une cliente qui attendait depuis septembre 2025 l’enregistrement de sa demande d’admission exceptionnelle au séjour.

La préfecture du Val-d’Oise lui avait fixé un rendez-vous au 9 mars 2027, soit environ 18 mois après sa demande.

Dans son ordonnance du 13 août 2026, le Tribunal a reconnu l’urgence de la situation, notamment en raison du risque de perte de son emploi.

Le juge a ainsi ordonné au préfet du Val-d’Oise :

✅ de convoquer la requérante en préfecture dans un délai de 15 jours ;
✅ de lui permettre d’enregistrer sa demande d’admission exceptionnelle au séjour ;
✅ de lui délivrer un récépissé, sous réserve de la complétude de son dossier.
L’État a également été condamné à lui verser 500 euros au titre des frais de procédure.

Cette décision rappelle qu’un délai excessif pour accéder à un rendez-vous en préfecture peut être contesté lorsque le demandeur démontre l’urgence et l’utilité de la mesure sollicitée.

Nous sommes heureux d’avoir obtenu cette décision pour notre cliente et de lui permettre de faire avancer une situation administrative bloquée depuis près d’un an.

Chaque situation reste toutefois particulière et doit faire l’objet d’une analyse individualisée.
