Immigration Update (France)

A five-year visa refusal may be imposed where a prior OQTF (removal order) has not been complied with. In its Decision No. 2026-1196 QPC (April 17, 2026), the Conseil constitutionnel confirmed the validity of this framework, while expressly conditioning its application.

First, the competent authority remains under an obligation to assess, in each case, the consequences of a refusal on the individual’s right to family life (article 8 of the European Convention Safeguarding Fundamental Rights and of Human Rights).
Second, the legal basis for the five-year bar disappears where the underlying OQTF has been withdrawn or set aside.

From a practical standpoint, both limitations must be affirmatively relied upon in any case involving a prior OQTF.
