Another Nolle Pros. Another reminder of why criminal defense investigations matter.

Our client, a military veteran suffering from a traumatic brain injury and seizure disorder, was extradited from Florida to Georgia on serious felony allegations involving solicitation of a minor and child sexual exploitation. His phone was seized and forensically examined. No evidence was found.

Still, he spent nearly 10 months in custody, where he was assaulted and allegedly given incorrect medication that severely impacted his health.

When Lerner Consulting was brought into the case, we conducted a procedural and investigative review and quickly identified major concerns with the probable cause used to obtain the warrant. The case heavily relied on a cell phone number database search with questionable reliability.

Our investigators then conducted an independent test. After confirming our client was incarcerated and the original phone was secured in law enforcement custody, we texted the number tied to the alleged crimes from a controlled burner phone.

Someone answered.

That individual immediately began attempting to solicit pornographic material from who they believed was a minor. The evidence was preserved, documented, and transferred through proper chain of custody to defense counsel. Further tracing revealed the number was associated with multiple individuals — not just our client.

The findings were presented to the District Attorney’s Office.
The case was later Nolle Prossed.

This case is another example of how important it is for defense teams to understand criminal procedure, digital evidence, investigative methods, and evolving technology. Sometimes the truth is buried underneath assumptions and bad investigative practices.

Our client was not just a defendant. He was a victim of cell phone spoofing.

Being able to call this family and tell them “it’s over” is exactly why we do this work.
