She moved to Gainesville as a college freshman to attend the University of Florida. It is there that she earned a Bachelor of Arts with honors in Philosophy in 2011, a Juris Doctor Degree with honors in 2016, and a Master of Laws in Taxation in 2017. Katie is a people per

son, an avid hiker, and a coffee enthusiast. She loves the counselor role of being an attorney, which allows her to get to know her clients and tailor solutions to meet their estate planning needs. Today is "National Senior Fraud Awareness Day" — an important reminder that protecting your loved ones is not only about wills and trusts, but also helping safeguard them from scams, financial exploitation, and fraud.

🛡️ Protecting Seniors Goes Beyond Estate Planning

At Dignity & Trust Law, we often remind families that one unexpected scam, fraudulent phone call, or stolen piece of information can create financial and emotional stress during some of life’s most vulnerable moments.

💡 **THE FACTS (What Actually Happens):**
✔ Debt is paid from your **estate** (what you leave behind)
✔ Creditors can make claims—but only against those assets

What is Probate—and When Do You Need It?
Probate is the legal process through the court system that takes place after someone passes away. Its purpose is to make sure debts are paid and assets are properly distributed to the correct heirs or beneficiaries.
📌 In Florida, probate may be required when:
• A person passes away owning assets in their name alone
• There is no designated beneficiary (like on a bank account or life insurance policy)
• Real estate is owned solely by the deceased person
• The total value of assets requires formal court administration
📖 What happens during probate?
• The court identifies and appoints a personal representative (executor)
• Debts and taxes are reviewed and paid
• Remaining assets are distributed according to a will—or Florida law if there is no will
⚖️ Important to know:
Even if you have a will, your estate may still go through probate. A will does not avoid probate—it simply directs the court on how to distribute your assets.

⏳ Probate can take several months to over a year, depending on the complexity of the estate.
💡 When is probate NOT required?
