An Immigration Master Hearing is usually the first court hearing in an immigration case. It may seem simple, but it is a very important step in the deportation process.

During the Master Hearing, the immigration judge will:
• Confirm the person’s identity
• Review the immigration charges
• Ask whether the person has an attorney
• Set deadlines for applications and evidence
• Schedule future court dates

This hearing is not usually the final trial. Instead, it is where the court organizes the case and determines the next steps. Missing a Master Hearing can lead to a deportation order in absentia, which means the judge may order removal if the person does not appear.

Habeas Corpus is one of the most important legal protections in the United States. The term means “you shall have the body,” and it gives people the right to challenge unlawful detention before a judge.

In immigration cases, a Habeas Corpus petition may be used when someone is being detained unlawfully, denied due process, or held for an unreasonable amount of time without proper review.

This legal action can help protect fundamental rights and hold the government accountable to the law. Every case is different, and understanding your options is critical when a loved one is in immigration detention. Know your rights because knowledge is power!

Courts are fighting back! Know Your Rights!
A federal appeals court just struck down the Trump administration's policy of denying bond hearings to immigrants in detention, a policy that triggered tens of thousands of lawsuits across the country for unconstitutional detention.
This matters for you and your loved ones.
Under the law, most people held in immigration detention have the right to a bond hearing, a chance to fight for their freedom while their case is decided. That right is not something the government can simply take away.
This legal battle is heading to the Supreme Court, which means the situation could change again. Now more than ever, having the right attorney in your corner is critical. Read more here: https://apnews.com/article/immigration-bond-policy-trump-washington-judges-976cd214de879948f324988a60a96d4b

Is Someone You Love Detained by ICE? Here's What You Need to Know About Immigration Bond Release.
When ICE detains a person, it can feel like the walls are closing in. Families are separated. Fear takes over. But there may be options, and understanding them could make all the difference.
What is an Immigration Bond?
An immigration bond is a way for a detained person to be released from ICE custody while their immigration case continues in court. Think of it as a promise to the court, a financial guarantee that the person will show up to every hearing. A bond amount can be set by ICE or by an immigration judge. Once paid, your loved one can come home while the legal process moves forward.
Here's what every family needs to understand:

A bond release does not end the immigration case, court appearances are still required
Not everyone qualifies for bond, it depends on the individual's history and circumstances
A bond hearing can sometimes be requested to lower a bond that's too high to pay
Strong family ties, stable employment history, and community support can all help make the case for a lower bond

Time matters. The sooner an experienced immigration attorney gets involved, the better the chances of a favorable outcome.

100,000+ U.S. Citizen Children. Separated from Their Parents.
A new report from the Brookings Institution reveals that since early 2025, more than 100,000 American-born children have had at least one parent detained during immigration enforcement raids.
Let that sink in. These are U.S. citizens, children who wake up one day, and their mom or dad is gone.
As the son of Haitian immigrants, this resonates deeply with me. This isn't just a policy debate. These are real families. Real children. Real trauma. Source: https://people.com/trump-immigration-raids-detained-parents-100k-children-report-11978683

As President Donald Trump follows through on his pledge to launch immigration raids across the country and orchestrate mass deportations, an estimated 145,000 U.S. citizen children and north of 50,000 children under the age of 6 have had a parent detained by federal immigration officials, according....

U.S. immigration detention is one of the most important and controversial parts of the immigration system today.

Thousands of immigrants, including asylum seekers and families, are held in ICE detention centers while their immigration cases are pending. Some are detained after crossing the border, while others are arrested inside the United States during enforcement operations.

Immigration detention is considered civil detention, not criminal punishment, but many detainees are held in jail-like conditions for weeks, months, or even longer.

Common concerns raised by attorneys and advocacy groups include:
• Overcrowding
• Delays in medical care
• Limited access to lawyers
• Mandatory detention without bond
• Family separation
• Conditions inside detention facilities

At the same time, the government argues that detention is necessary to enforce immigration laws, ensure court appearances, and protect public safety.

Many immigrants may still have legal options, including:
• Bond requests
• Asylum applications
• Cancellation of removal
• TPS
• Appeals
• Prosecutorial discretion

If you or a loved one is facing immigration detention, it is extremely important to speak with an experienced immigration attorney as soon as possible to understand your rights and available options. Knowledge is power!

IMPORTANT IMMIGRATION UPDATE | May 22, 2025
We want to make sure our community is informed about a significant policy update from U.S. Citizenship and Immigration Services (USCIS).
USCIS has just issued a new policy memo confirming that individuals seeking to adjust their immigration status must do so through consular processing, meaning you must go through the U.S. Department of State at a U.S. Embassy or Consulate outside of the United States.
This is not a new law; it reaffirms long-standing immigration rules that have been in place for years. However, this memo makes it clear that USCIS officers will review each case individually, looking at all the facts before deciding whether someone qualifies for this process. Read more here: https://www.uscis.gov/newsroom/news-releases/us-citizenship-and-immigration-services-will-grant-adjustment-of-status-only-in-extraordinary

What does this mean for you?
If you're hoping to get a green card or adjust your status, the path forward likely requires consular processing abroad. Every case is different; your eligibility depends on your specific situation. Do not make any moves without speaking to a qualified immigration attorney first.
The rules are changing. The stakes are high. Now is not the time to guess.

At the Law Office of Attorney Calvin Pierre, we understand this community because we are this community. Attorney Pierre is the proud son of immigrants. He knows your journey, and he fights for your future.
Have questions about your case? Send a direct message. Our team is ready to help you understand your options.

A Master Hearing is usually the first hearing in Immigration Court. It may seem short and simple, but it is VERY important because it sets the direction of your case.

During the hearing, the Immigration Judge may:
• Confirm your identity and address
• Review the charges against you
• Ask if you are applying for relief such as Asylum, TPS, or another immigration benefit
• Set deadlines for applications and evidence
• Schedule your next court hearing

IMPORTANT TIPS:
• Arrive early
• Dress professionally
• Bring all your documents
• Be respectful and answer clearly
• If you need more time to find a lawyer, ask the judge
• If you do not understand something, say so

Never miss your hearing! Missing court can result in a deportation order issued in your absence.
Remember: the Master Hearing is usually NOT the hearing where you tell your full story. It is mainly for procedure and scheduling.

This is for general information only, and does not constitute legal advice.

The Trump administration has sworn in 82 new immigration judges, the largest class in U.S. history. The goal is simple: move deportation cases faster.
More judges means shorter wait times between hearings. Read more here: https://www.cbsnews.com/news/trump-administration-82-new-immigration-judges-deportation-cases/

What does this mean for you?
More judges = faster hearings = less time to prepare your case.
If you or someone you know has an open immigration case, a court date coming up, or has received any notice from immigration authorities, you need to speak with an Immigration Attorney now, not later.

Attorney Pierre has been in this community for years. As the son of immigrants, he understands what is at stake for your family. This is not the time to wait and hope for the best.

The additions come after the ouster of dozens of immigration judges across the country by the Trump administration over the past year.
