Last week, LDGA, together with and , filed a nationwide consumer class action, Dalora v. Dexcom, Inc., No. 3:25-cv-03210 (S.D. Cal. 2025), alleging that Dexcom implemented a significant design change to its G6 and G7 continuous glucose monitors without obtaining required FDA clearance. The FDA found that this undisclosed modification rendered the devices adulterated and misbranded.

Despite the design change, Dexcom continued to market the sensors as “FDA-approved,” “highly accurate,” and requiring “no fingersticks.”

Consumers paid a price premium based on these representations and would have paid less, or not purchased the product at all, had the truth been disclosed. The lawsuit seeks relief for consumers nationwide who purchased these modified CGM sensors.

📢 Appellate Win for Bruce Greenberg! LDGA is proud to share that the Appellate Division reversed and remanded a trial-level dismissal in a case involving jurisdiction under the Protection of Domestic Violence Act vs. the Victim’s Assistance and Survivor Protection Act.

As the court noted, while the parties did have a “family-like” relationship (step-children in common), the defendant had no parental rights and had been barred from any contact with the children for over five years, which places the case outside the scope of the PDVA. The Appellate Division reversed the dismissal, reinstated plaintiff’s VASPA action and temporary restraining order, and remanded the matter to Bergen County for further action.

This decision provides important guidance on jurisdictional boundaries in protective-order litigation.
