Maran & Maran, PC. With 34 years of experience, I continue to maintain a personal injury and malpractice specialty and my commitment to helping clients.

Maran & Maran was formed in 1986 soon after I joined my father, Joe Maran, at Gateway 1 in Newark. When I joined him, he was already a seasoned and acclaimed personal injury trial lawyer. I had the privilege to train under and work with my father in a specialized personal injury and malpractice firm for 22 years until he retired. My father has since passed away. After leaving the Gateway building,

the firm moved to the Legal Center where I practiced for twenty years until I moved the firm to the other side of Penn Station at our current location. With 30 years of experience, I continue to maintain a personal injury and malpractice specialty and my commitment to helping one client at a time from retention to resolution.

Scaffolding Accidents and the Importance of Evidence Collection

Scaffolding injuries often involve private companies that set up and rent the equipment. David Maran explains that if scaffolding is improperly installed, those companies can be held responsible. After serious job site accidents, OSHA and insurance investigators may gather key evidence. A lawyer’s role is to secure these reports and collect additional proof to build a strong negligence claim.

Real Case: Electrocution Injury Caused by Unsafe Job Site

David Maran shares a case where an electrician fell through an unprotected stairwell opening because the contractor failed to install safety barriers. The result was a severe spinal injury. Since the contractor had a duty to secure the site, this became a negligence claim in Superior Court. These cases show how fact-sensitive construction accidents can be when determining liability.

Why You Need Both Workers’ Comp and Injury Specialists

Workers’ compensation cases are handled in a separate court system with unique rules and judges. David Maran explains why specialists in workers’ comp often achieve faster and better results. On the other hand, third-party negligence cases are pursued in Superior Court. Having the right type of lawyer for each case ensures both sides of your claim are handled effectively.

Unsafe Equipment and Property Owner Negligence on Job Sites

Construction injuries are not always caused by co-workers. David Maran explains that if a piece of equipment is defectively designed or manufactured, that may lead to a products liability case. Similarly, if a property owner fails to maintain a safe worksite, they could be held negligent. These are examples of third-party claims that go beyond workers’ comp coverage.

Can Car Accidents Count as Third-Party Claims in Construction Work?

Not all construction injuries happen directly on the site. David Maran explains that if you are driving for work and another vehicle causes an accident, this creates both a workers’ comp claim and a third-party negligence claim. The combination allows injured workers to pursue medical coverage and lost wages through comp while also seeking broader damages against the at-fault driver.

When Is a Construction Injury More Than Just Workers’ Comp?

Some job sites are entirely controlled by one employer, which limits claims to workers’ comp. But David Maran explains that most construction projects involve multiple trades and companies, creating many opportunities for third-party claims. For example, if unsafe equipment is supplied by another company or a machine lacks proper safety guards, you may have a claim beyond comp.

What Benefits Does Workers’ Comp Provide in New Jersey?

Workers’ compensation covers injured employees even if the accident wasn’t anyone’s fault. David Maran explains that benefits include medical care approved by the insurance company, temporary wage replacement if you cannot work, and payments for permanent disability if you are left with lasting injuries. These protections are automatic as long as the injury happened on the job.

Understanding Third-Party Claims in Construction Accidents

Third-party claims allow victims to recover damages from someone other than their employer or co-worker. David Maran explains with an example: if a delivery truck driver from another company hits a worker on-site, that driver and company may be held responsible. These cases go beyond workers’ comp and can provide much greater compensation.

Is Workers’ Compensation the Only Option After a Construction Injury?

David Maran explains that while workers’ compensation is often available for construction site injuries, it may not be the only option. If someone other than your employer or a co-worker caused the accident, you could also bring a third-party action. This allows victims to pursue additional compensation outside of workers’ comp, depending on who was truly at fault.

How Third-Party Claims Work Alongside Workers’ Comp

David Maran explains how lawyers investigate third-party claims by gathering photos, reports, and witness statements. When a settlement is reached against a third party, state law requires part of it to be repaid to the workers’ comp carrier. While this benefits the employer’s insurance costs, it also ensures that the injured worker still receives more than workers’ comp alone would provide.
