Tip of the Day: Know Your Rights Amidst New ICE Policies 🛑

It is important to stay updated on shifting immigration enforcement rules. Traditionally, we’ve shared that ICE cannot enter your home without a judicial warrant (signed by a judge).

However, a recent internal ICE memo (May 2025) has changed their internal guidance. ICE agents are now being instructed that they may use administrative warrants (specifically Form I-205) to enter homes if they are seeking someone with a final order of removal.

What you need to know:

The Policy Shift: ICE now claims they can enter a home using only an administrative warrant signed by their own officials, rather than a judge, if there is a deportation order.

The Constitutional Conflict: Many legal experts and civil rights groups argue this policy is unconstitutional and violates the Fourth Amendment. Legal challenges are already underway.

Safety & Communication: If agents knock, you still have the right to remain silent. You can ask them to slide any documents under the door or hold them to a window to see if it is a judicial warrant (signed by a judge) or an administrative one (Form I-205).

Verification: Check any warrant for the correct name and address. If they enter without a judicial warrant, do not resist physically, but clearly state: "I do not consent to this search or entry." Knowing the difference between these warrants is more critical than ever. Stay safe and informed! ⚖️
