WARNING: USCIS Tightens Deadlines for RFE Responses
Since the recent USCIS policy change, officers have more flexibility when setting response deadlines for Requests for Evidence, and we're now seeing some RFEs with deadlines as short as 30 days.
That is a significant change from the longer response periods many applicants have been accustomed to. For EB1A, EB2 National Interest Waiver, and other document-heavy cases, 30 days may leave much less time to gather supporting evidence and prepare a complete response. ⚖️
If you receive an RFE, it is important to pay close attention to the deadline listed in the notice rather than assuming you will have the longer response period used in the past.
