WARNING: USCIS Tightens Deadlines for RFE Responses

Since the recent USCIS policy change, officers have more flexibility when setting response deadlines for Requests for Evidence, and we're now seeing some RFEs with deadlines as short as 30 days.

That is a significant change from the longer response periods many applicants have been accustomed to. For EB1A, EB2 National Interest Waiver, and other document-heavy cases, 30 days may leave much less time to gather supporting evidence and prepare a complete response. ⚖️

If you receive an RFE, it is important to pay close attention to the deadline listed in the notice rather than assuming you will have the longer response period used in the past.

NEW RULE: USCIS Can Now Obtain Green Card Sponsors' Credit Reports

If you are sponsoring a relative for a family-based green card, there is an important change you need to know about.

As of August 31, 2026, USCIS is requiring the new 08/24/26 edition of Form I-864, Affidavit of Support.

The new form includes a privacy release that authorizes USCIS and the Department of State to request information from consumer reporting agencies, including credit information, for financial sponsors and joint sponsors.

While USCIS has not announced how credit scores affect cases, credit information can now be part of the information available to the government when evaluating the Affidavit of Support. ⚖️

Will the Government Warn You Before You Trigger the Unlawful Presence Bars?

Will the government notify you if your international travel risks triggering an unlawful presence bar? No.

U.S. immigration agencies do not provide individualized legal advice, so ensuring that a departure on Advance Parole won't compromise your status is entirely up to you.

If a 3-year or 10-year bar is triggered by your travel, you will likely only find out at the port of entry when attempting to re-enter, or later when USCIS denies your adjustment of status application. Consulting an immigration attorney prior to international travel is essential.

Can You Still Get a Green Card After Turning 21? CSPA Explained

Turning 21 doesn't automatically mean a child loses the ability to get a green card through a parent.

The Child Status Protection Act can change how the child's age is calculated for immigration purposes. The time an underlying immigrant petition was pending can be subtracted from the child's age. If the resulting CSPA age is under 21, the child may still qualify for the green card process.

However, CSPA is not automatic. There are specific requirements and exceptions, including rules involving marriage, so the calculation needs to be reviewed carefully. ⚖️

Can You Keep Working After Your I-94 Expires? The 240-Day Rule Explained

If your employer filed your extension petition before your I-94 expired, you don't need to panic if a decision hasn't come through yet.

For most employment-based categories, including H-1B, L-1, O-1, E, and TN, you receive an automatic 240-day extension of your employment authorization while USCIS adjudicates the case. As long as the extension was filed on time, you can continue working past your I-94's expiration date. ⚖️
