✨MuBANY's Ramadan Guide is live! ✨ As we approach Ramadan this year, the guide provides an introduction to the religious practices and expressions of many Muslims and is meant to serve as a reference tool for law firms, law departments, and other legal employers when responding to the needs of their Muslim employees. We hope the guide will be helpful in informing legal employers about Ramadan and what it means for their Muslim colleagues.

MuBANY is proud to have signed on to a brief in support of a historic New York voting rights law in Fossella v. Adams. The law, which would extend the right to vote to about 800,000 non-U.S. citizens, is being challenged.

The lawsuit asks the New York Supreme Court of Richmond County to block the law and prohibit noncitizens from registering and voting. The court struck down the law finding that it violated the New York Constitution, New York election law and the Municipal Home Rule law. The city and residents appealed the Fossella v. Adams decision to the Appellate Division, Second Judicial Department.

MuBANY is proud to have led an amicus brief on behalf of religious organizations in Walker v. Baldwin, et al filed in the the U.S. Court of Appeals for the Seventh Circuit. The plaintiff in this case is a Rastafarian who was forced to shave his dreadlocks while incarcerated in an Illinois state prison. Mr. Walker sued under RLUIPA, asking for money damages against the state officials in their personal capacity. We believe that prisoners and other incarcerated persons should be able to exercise their religious beliefs freely and have urged courts to recognize a damages remedy against officials in their individual capacity under RLUIPA and vindicate Mr. Walker’s right to religious freedom.

The Supreme Court unanimously recognized in Tanzin v. Tanvir—a case in which MuBANY together with an interfaith coalition submitted an amicus brief—that the Religious Freedom Restoration Act (RFRA) authorizes suits for money damages against federal officials in their individual capacity. This case presents the same issue as in Tanzin but with respect to a similar federal statute—the Religious Land Use and Institutionalized Persons Act of 2000 (RLUIPA). To read the brief please check out our link tree: linktr.ee/mubany or go to the link in our bio.

MuBANY also expresses a special thanks to Patterson Belknap Webb & Tyler for spearheading this amicus brief.

✨MuBANY congratulates Zainab A. Chaudhry for being nominated by Governor Kathy Hochul to be the first gubernatorially-appointed in the state ever! ✨

MuBANY is proud to have endorsed Ms. Chaudhry for this nomination. Ms. Chaudhry has been part of the MuBANY network since 2016, when she co-presented a continuing legal education (“CLE”) course entitled “The Muslim-American Community: An Introduction to the Basics of Islam and Relevant Emerging Legal Trends.” Ms. Chaudhry provided a unique perspective by describing her experience litigating matters related to the free exercise of religion in prison. Ms. Chaudhry’s qualifications make her uniquely equipped to be a Judge on the New York State Court of Claims. Having spent the entirety of her professional career working in a variety of legal capacities in the state’s government and judiciary, she has an unparalleled understanding of the Court and the judicial role. The New York State judiciary needs brilliant, contemplative, and highly credentialed candidates like Ms. Chaudhry. New York State’s judiciary today does not reflect the New York it presides over, and the Muslim community, in particular, remains woefully underrepresented. There are no Muslim judges on the Court of Claims. Indeed, as of 2022, there is to our knowledge no gubernatorial appointed member of the state judiciary who identifies as Muslim—nor has there ever been. We are grateful to Ms. Chaudhry for trailblazing this path and congratulate her on this achievement.✨👏🏽

We also applaud Governor Hochul’s welcomed commitment to achieve a more and by appointing Ms. Chaudhry to the Court of Claims. The importance of a diverse judiciary cannot be understated and to further that cause, MuBANY created its Judiciary initiative, which identifies and creates pipelines to opportunities within both the state and federal judiciaries for our members and other under-represented communities.
