Yet New York’s wrongful death law often limits recovery to medical expenses and lost income. The Grieving Families Act aims to give families a fuller path to justice by recognizing the real, human impact of their loss.

New York’s wrongful death statute has remained largely unchanged since 1847. The Grieving Families Act offers an opportunity to bring the law in line with the vast majority of the country and recognize that the value of a life does not equate to a paycheck.

Patients generally have the right to access their medical records, including the ability to review and obtain copies. New York law also reinforces these rights under Section 18 of the Public Health Law.
