As we head into the long weekend, it’s a good moment to pause and recharge.

Labor Day is not just about hard work—it’s also about honoring the value of rest and reflection. We are grateful for the chance to step back, spend time with the team, and come back refreshed for what’s ahead.

Wishing everyone a safe and restorative Labor Day weekend!

It is important to understand the free speech debate.

I was very lucky and honored to be able to interview Nadine Strossen about free speech and how many students – in particular – are surprised about the interconnection between free speech and human rights.

Nadine is the former President of the ACLU and Professor Emerita at New York Law School – where she may have faced her biggest challenge: teaching me Con Law.

Another great victory for the Po***ck Cohen team! Today, the NY Appellate Division 1st Department issued an opinion unanimously reversing the Supreme Court in favor of our client, a former New York City employee and whistleblower. The First Department, in a case of first impression, held that NY Civil Service Law § 75-b protects public sector whistleblowers from post-employment retaliation like blacklisting and defamatory job references, reviving our client’s claim for retaliation and denying the defendants’ motion to dismiss. This is a great victory not just for our client, but for all public sector whistleblowers in New York.

Our client was represented by Max Rodriguez, who argued the case before the 1st Department on March 1st, Adam Po***ck, and Ben Battles. You can read the opinion here:

In a Bloomberg Law Insight, senior counsel Ben Battles discusses how the $73 million settlement between survivors of victims of the Sandy Hook school shooting and gun maker Re*****on Arms could prompt other plaintiffs to deploy the novel strategy of using state consumer laws to overcome federal liability protection.

"Plaintiffs' amended complaint alleges in hundreds of detailed allegations that Reddit refuses to prevent, detect and remove known illegal content or ban repeat offenders who traffic in child po*******hy — all to Reddit's profit." - Law360 covers the opening brief in the Ninth Circuit appeal of our class action lawsuit with Susman Godfrey against Reddit. Plaintiffs argue that Section 230 immunity does not shield Reddit from the suit. Po***ck Cohen attorneys and Raphael Janove helped on the brief, which is available here: https://bit.ly/3hDwej0

A proposed class has urged the Ninth Circuit to revive its case against Reddit that alleges Section 230 liability protections do not shield the company from allegations of profiting off child po*******hy, saying a district judge erred in tossing the case.

Our attorney Rafi Janove argued that district courts presiding over class actions should be able to send out notice to class members before excluding them based on arbitration defenses, giving class members potentially subject to arbitration clauses their day in court. Read his post on Law360:

With its upcoming ruling in Bruno v. Wells Fargo — a Fair Labor Standards Act collective action — the Third Circuit should break with Fifth and Seventh Circuit precedent and side with employees to give district courts discretion to send notice to class members before deciding whether claims are ...
