New York State announced that the suspension of evictions and foreclosures has been extended to March 16, 2021. Here's what NYC landlords and tenants need to know:

New York Governor Andrew Cuomo announced the extension of executive order 202 for an additional 30 days to March 16, 2021. Executive order 202 was enacted on March 7, 2020 in response to crisis caused by the Covid 19 pandemic.

This means that landlords will now have to wait longer before they can begin housing court proceedings. Emergency cases can be filed in instances where the tenant(s) pose a danger to the landlord or other tenant(s) safety.

The extension enables tenants to stay in their current housing unless the tenant creates nuisance conditions which endanger other building residents.

The June 2019 rent laws changed predicate notice requirements. Landlords should consult their attorneys to determine the notice rents for their particular case. These notices are required before housing cases can be filed. Tenants should seek to make payment arrangements. The extension should be used to position yourself for when the housing courts reopen.

Petition signature collection start date delayed and petition collection period reduced

The start of the petition collection period for the 2021 New York State June 22nd primary election, originally slated to begin on February 22nd, 2021, will now commence on March 2nd, 2021. The collection period ends March 26yh, 2021.

This collection period is now twenty-four days rather than the usual six week period. The signature requirements were also reduced. These changes are due to the Covid 19 pandemic. Petition submission dates are now March 22nd to March 26th, 2021.

This year’s candidates therefore have another week to ensure their petition collection operations are ready and a shorter time period to collect the reduced signatures required.
