Great discussion at Bisnow's New York Multifamily Operations & Development Conference this week.

BBG Partner David Shamshovich joined the panel "Development Strategies to Increase Construction Pipeline" to discuss the realities of multifamily development in New York City today. The conversation focused on strong demand and rent growth alongside challenges including tighter equity markets, cautious lending conditions, project economics, land values, and the impact of 485-x and prevailing wage requirements on development decisions.

As co-chair of BBG's Tax Exemptions and Zoning Incentives Group, David works closely with developers navigating these issues every day. He shared insights on the interaction between zoning and tax incentives, the practical realities of 485-x underwriting, and emerging programs and policy initiatives designed to support housing production throughout New York City.

Scott Loffredo was recently quoted by amNewYork in an article examining the lawsuit challenging the New York City Rent Guidelines Board's decision to freeze rents for nearly one million rent-stabilized apartments.

In the article, Scott discussed the legal arguments advanced by landlords seeking to overturn the Board's June determination. He described the lawsuit as "incredibly strong" and "legally sound," while acknowledging that the petitioners face an uphill battle in convincing the court that the Board acted arbitrarily and capriciously. Scott also questioned the argument that the rent freeze was politically predetermined, explaining that a focus on political influence could detract from what he considers a strong evidentiary record supporting the challenge.

BBG recently secured a preliminary injunction on behalf of a property owner in a New York Supreme Court action involving claims of breach of lease and private nuisance. The court granted significant interim relief addressing ongoing conduct that was affecting building operations, residents, and staff while the litigation proceeds, and included protections designed to prevent further disruptive conduct during the pendency of the action.

The decision provides useful guidance in nuisance-related matters and highlights the remedies available to property owners confronting conduct that impacts building communities and management operations.
