Congratulations to partner Stacee Vaikness and the entire Jones Jones LLC team on a significant victory before the New York State Supreme Court, Appellate Division, Third Department.

In this important appellate decision involving a large public transportation entity, the Third Department affirmed that an employer’s filing of a First Report of Injury utilizing an “L” code did not constitute a binding acceptance of liability and did not preclude the employer from later controverting the claim.

The Court also affirmed the denial of the claimant’s alleged psychological injury claim, agreeing that the claimant failed to demonstrate stress greater than that ordinarily experienced in the course of employment.

This is an important decision addressing both compensability standards for psychological injury claims and the legal effect of employer filing codes in New York workers’ compensation proceedings. We are incredibly proud of Stacee and the entire Jones Jones team for securing this major appellate victory before one of New York’s most influential courts.

Congratulations to Sarah Vulcano on the successful disqualification of a workers’ compensation claim on behalf of a Jones Jones’ insurance client. Through careful examination of documentation, Sarah and her team were able to prove the claimant had previously made misrepresentations to secure workers’ compensation benefits and secure full lifetime disqualification of the claim, plus partial repayment of benefits to the client. Congratulations to Sarah, her team and the client for this major win!

Last Friday, we brought together our New York and New Jersey teams at Casa Cipriani for our annual Jones Jones Summit.

It was a great day of collaboration, strategy, and forward-thinking discussions around the latest developments in workers’ compensation, emerging trends, client expectations, and how we can continue to deliver the best possible results for the employers, carriers, and self-insureds we represent.

One of the best parts of the day was having attorneys from across both states together in one room, sharing ideas, challenging each other, and discussing innovative ways to better serve our clients.
