Oved & Oved LLP successfully vacated a confession of judgment filed in Kings County against two of its merchant clients by a lender operating as a merchant cash advance company. ⁣⁣
⁣⁣
The Court rejected lender’s arguments that the transaction represented a legitimate purchase of the defendants’ receivables and fully adopted the firm’s position that the transaction had all the hallmarks of a loan, including an interest rate of almost 100%, and was therefore void as usurious.⁣⁣
