A National Interest Waiver (NIW) is a pathway for foreign nationals to obtain a green card (permanent residency) in the United States under the Employment-Based Second Preference (EB-2) category. The key advantage of an NIW is that it waives the requirement for a U.S. employer to file a labor certification and a job offer. Instead, the applicant can self-petition if they can demonstrate that their work is in the national interest of the United States.

Who Qualifies for an NIW?

To qualify, an applicant must meet the general EB-2 criteria (advanced degree or exceptional ability) and satisfy the Matter of Dhanasar (2016) three-prong test, which replaced the earlier NYSDOT standard.

1. Substantial Merit and National Importance
• The work must have substantial merit in fields like business, education, health, science, technology, arts, or others.
• It must also have a significant impact on a national scale, such as improving public health, economic growth, or technological advancement.

2. Positioned to Advance the Work
• The applicant must prove they have the qualifications, expertise, experience, and a record of past accomplishments to carry out the proposed work.

3. Balancing Test
• The benefits of waiving the labor certification and job offer requirements must outweigh the potential benefits of requiring them. This often involves showing that the work is urgent, highly beneficial, or impractical to carry out if bound by traditional employment requirements. Will Biden put into place TPS extensions before Trump takes office ?

According to the latest data, there are over 850,000 TPS holders, as of March 2024. Around 350,000 Venezuelans, 200,000 Haitians and 180,000 Salvadorans make up the largest group of beneficiaries.

Approximately 300,000 TPS holders reside in Florida, while Texas has nearly 95,000, and New York and California each have around 68,000.

TPS holders are provided renewable relief for up to six, 12 or 18 months, but without an extension, many will begin losing their legal status in 2025. Protections for Salvadorans are set to expire first in March, with Venezuela, Ukraine and Sudan in April, and Nicraragua in July.

On Aug. 19, 2024, DHS implemented Keeping Families Together, a process for certain noncitizen spouses and noncitizen stepchildren of U.S. citizens to request parole in place under existing statutory authority.

Parole is an exercise of DHS’s discretionary authority under section 212(d)(5)(A) of the Immigration and Nationality Act (INA) to allow certain noncitizen “applicants for admission” to be present in the United States on a temporary, case-by-case basis for urgent humanitarian reasons or significant public benefit.
