The Department of Homeland Security (DHS) has issued an interim final rule implementing new immigration fees and requirements under the H.R. 1 Reconciliation Act of 2025, also known as the “One Big Beautiful Bill Act.” This legislation introduces additional fees aimed at strengthening funding for immigration enforcement operations and ensuring that noncitizens bear the cost of immigration-related services.

USCIS has completed the FY 2027 H-1B initial registration selection process. Employers with selected beneficiaries may now begin filing cap-subject H-1B petitions starting April 1.

U.S. Citizenship and Immigration Services has received enough electronic registrations for unique beneficiaries during the initial registration period to reach the fiscal year 2027 H-1B numerical allocations (known as the H-1B cap), including the advanced degree exemption (master’s cap).

USCIS announced that the FY 2027 H-1B initial registration period will run from March 4 to March 19, 2026. Employers and representatives must register beneficiaries through a USCIS online account and pay a $215 fee per registration. Only registrations selected in this process may file H-1B cap-subject petitions. Selection notifications are expected by March 31, 2026.

For FY 2027, a new rule changes how selections are made. If registrations exceed the cap, USCIS will use a weighted selection process that prioritizes higher-skilled and higher-paid beneficiaries, rather than a purely random lottery. If registrations do not exceed the cap, all properly submitted registrations will be selected.

He noted that the policy’s duration is unclear but expects legal challenges, with more clarity likely after court decisions.

Those who wish to submit new applications for family members will still be able to apply, but visas will not be issued for now.
