A “Rational Basis”

Recently the 9th Circuit United States Court of Appeals invalidated the results of a California referendum in regard to gay marriage. This post takes no position on the issue of gay marriage, but instead weighs in on the court’s fundamental lack of logic in its judicial reasoning.

The court essentially opined that the California voters had “no rational basis” to deny individuals the right to marry members of their own s*x. This is news to millions of California voters who while voting to elect Barack Obama as the first African American President, chose also to uphold the original definition of marriage as applying only to a man and a woman. The opponents of Gay Marriage may be totally misguided, but their point of view has thousands of years of tradition behind it, and support from all of the world’s major religions.

The real question is who gets to determine whether a principle has a “rational basis”, millions of voters in California and other states who have rejected same s*x marriage or a judge with the opposite opinion. What greater qualities does a judge possess over ordinary mortals that allow him to arrive at the conclusion that an opinion held by a large segment of the society has no “rational basis.” In fact in any contentious political debate on principles, one side of the political spectrum most likely believes that its position is correct and that the opposite side lacks a “rational basis” for its judgment.

In actuality, the 9th Circuit’s magistrate is expressing an opinion no better than any other individual. This cannot be the basis of American law. The answer is for our great democracy to be allowed time to reach a decision either through its state legislatures or by referendum of the voters. As we are still a government “by the people,” the courts should not be permitted to usurp the voice “of the people.”

I shall be using this venue as a place to express my observations mostly related to the law, but not entirely limited to that subject. I will also venture into some political controversies but mostly to discuss the legal aspects regarding the particular political issue of interest.

In that regard it is important to point out that when a political issue reaches a court, the matter is almost never determined “on the merits.” For example on the issue of birth control, courts never determine whether this activity is “right” or “wrong,” rather the issue for the courts is whether it is constitutionally protected. (On this matter the courts have long determined that no state or federal law may infringe upon this right.) It is the Congress and the state legislatures that debate “right” and “wrong,” and “good” and “evil.” This is an essential distinction that will be highlighted in my posts.

Besides the great issues of the day, I shall provide legal tips and answer general legal questions. I may also venture off into two of my favorite subjects – science and religion, and will try to keep it as non-controversial as possible. Generally, anything that strikes my fancy will be discussed.
