🚨 SEPTEMBER 18, 2026 COULD CHANGE HOW YOUR GREEN CARD APPLICATION IS REVIEWED.

A new public-charge rule takes effect on September 18, 2026, for Adjustment of Status applications filed on or after that date and certain applicants seeking admission.

USCIS may have broader discretion to review your:
• Age & health
• Family circumstances
• Assets & finances
• Education & employment prospects
• Certain public benefits
• Credit & other relevant financial evidence
• Affidavit of Support (when required)

Instead of a simple checklist, officers may evaluate the totality of your circumstances. One negative factor or one public benefit does not automatically mean denial, but all positive and negative factors may be weighed together.

If you're eligible and your case is complete, speak with an immigration attorney about whether filing before September 18 is appropriate. Don't rush an incomplete application just to meet the deadline.

* Pending Adjustment of Status? Travel is generally not advised without proper authorization.

Are you an F-1 student in the U.S.? The way you maintain your status may soon look very different.

Beginning September 15, 2026, DHS is changing how many F-1 students are admitted to the United States. International travel after this date could mean receiving an I-94 with a fixed expiration date instead of Duration of Status (D/S).

If you're already in valid F-1 status and your I-94 shows D/S, you may not need to take immediate action—but maintaining your status remains critical. If you travel abroad and return on or after September 15, 2026, different rules may apply.

Before booking your next flight:
✔️Check your I-94.
✔️Review your program end date.
✔️Understand how the new rule affects travel, extensions, OPT, and STEM OPT.

🚨 Green Card applicants: A major public-charge rule change takes effect on September 18, 2026.

Immigration officers may now conduct a broader, case-by-case review when determining whether an applicant is likely to become dependent on government assistance in the future.

They may consider factors such as:
• Income, assets, and debts
• Age and health
• Family circumstances
• Education, skills, and employment
• Affidavit of Support and sponsor finances
• Receipt of certain public benefits where applicable

This change may affect both Adjustment of Status applicants in the U.S. and certain immigrant visa applicants abroad.

Receiving public benefits does not automatically result in a denial. Officers must review the totality of the circumstances before making an individualized decision. Certain humanitarian categories, including many VAWA, refugee, and asylum-based applicants, remain exempt.

USCIS will also require a revised Form I-485 beginning September 18, 2026.
