The client allegedly struck an across the street neighbor with a shovel that arose over a dispute about a parking spot during snow removal. Fortunately, the client’s family reached out to me quickly and I was able to oversee a search for surveillance footage. Surveillance from neighbors’ cameras raised serious doubts about the complaining witness’ allegations including whether the client was ever close enough to make contact with her and, assuming he did, if he was acting in self-defense because she jabbed her shovel at him twice. After considering the weaknesses in their case, the DA’s Office offered an Adjournment In Contemplation of Dismiss, meaning the case will be dismissed.
