Uncontested does not mean you agree on everything today.

It means you agree by the time you file.

An uncontested divorce in New York is one where both spouses have settled property, debt, support, and — if there are children — custody and parenting time. Once those are agreed, the case moves through the court on papers instead of through appearances.

You can start out disagreeing. Most people do.

Questions about whether your situation qualifies? That is exactly what a consultation is for.

Who does the school call when your child is sick? Whoever is on the emergency contact list, in the order it's written — not both parents automatically.

If only one parent is listed, only one parent gets the call, and the other hears about it hours later secondhand. Most New York schools will list both parents if you ask, and you can usually ask about the order too.

Sort it before the first day rather than in October.

Navigating divorce in NYC? Understand the key differences between mediation and litigation. Mediation often offers lower costs, faster timelines, greater privacy, more control over outcomes, and reduced conflict—making it ideal for cooperative couples. Litigation may be necessary when disputes are high-conflict or legal enforcement is needed, but it typically takes longer and is more public. Learn which path aligns with your needs and how to move forward with confidence. Visit nyfamily.law to explore your options and make informed decisions about your future.

Can't agree with your co-parent about school?

If you share joint legal custody, education is a decision you make together. When parents don't agree, mediation is one of the options available before litigation.

Whether mediation is a good fit depends on your family. It isn't right for every situation, and we'd talk that through with you before starting.

Serving families across New York.

Who decides where your child goes to school?

If you share joint legal custody, neither parent gets to enroll a child unilaterally — education is a major decision, and major decisions are made together. Registering a child at a new school without the other parent's agreement is one of the fastest ways to end up back in court in September.

If you and your co-parent can't agree on a school, you have options before litigation. Mediation can resolve an enrollment dispute in weeks, not months — and it keeps the decision with the two of you instead of a judge who has never met your child.

Serving families across New York and all five boroughs.
