ABILITY TO REPAY RULES COMPLICATE LENDING

The ability to repay rules creates two types of loans, qualified and non-qualified mortgages. From the lenders p

erspective the non-qualified mortgage does not have a safe harbor from the claims coming out of the ability to repay rules. The QM has a safe harbor and is said to be safe from ability to repay claims but we know there are risks that extend beyond this. Even if a loan is considered QM there are still certain risks that can wind up making the QM mortgage a Non QM mortgage and other claims borrowers can assert against the lender. OUR SOLUTION

GoRion’s system carries the loan through steps in the origination process that will in reality reduce the lender’s risk on Non-QM and QM loans. Our process goes much further than protecting the lender against “ability to repay” claims. Our system will provide evidence to defend against claims such as Steering, Benefit to Borrower, Fair Lending and Reg Z. Our system is not all about protecting the lender. An important part of what we’re doing is educating the borrower. Our process educates the borrower early and throughout the loan process so they understand what is going on with their loan. This is all achieved in a way that the loan officer doesn’t have to spend a significant amount of time educating the borrower about their loan thus taking away time from their main function … to sell more loans
