Pomerantz has secured a significant win in the securities class action against Plug Power, Inc., led by Partner Tamar Weinrib with support from Of Counsel Jennifer Banner Sobers.

The Court largely denied Defendants’ motion to dismiss, allowing key claims to proceed and the case to advance.

The Court ruled that Plaintiffs sufficiently pled that Plug Power Inc. made misstatements about its timelines and supply-chain problems, causing significant losses for investors.

Pomerantz has secured a significant win in a class action against AMMO Inc. (Nasdaq: POWW), now known as Outdoor Holding Co. Pomerantz opposed and largely defeated five separate motions to dismiss filed by Defendants, allowing the valuable core claims to proceed.

The Court ruled that Plaintiffs sufficiently pled that Defendants concealed adverse information regarding related-party transactions with a barred executive as well as known failures in machinery at a new factory.

Monica Ramirez Almadani built her career advocating for immigrant and civil rights, has held various roles at the U.S. Department of Justice and currently serves on the U.S. District Court for the Central District of California.

She has made significant contributions to underserved and immigrant communities through her remarkable pro bono work.
She transitioned into private practice as Special Counsel, served as a Visiting Assistant Clinical Professor and Co-Director of the Immigrant Rights Clinic at the University of California, Irvine School of Law. In 2021, she became the President and CEO of Public Counsel, the largest pro bono public interest law firm in the U.S., which offers free legal services to underserved communities.

Pomerantz has achieved a significant victory in a securities class action against Western Asset Management Company (“WAMCO”), a global fixed-income investment firm, and its parent corporation, Franklin Resources, Inc. (Franklin Templeton).

The U.S. District Court for the Central District of California largely denied Defendants’ motions to dismiss claims alleging that WAMCO and its former Chief Investment Officer engaged in a years-long cherry-picking scheme that allocated gains to favored accounts and losses to mutual funds in which Pomerantz’s client, Abilene Firemen’s Relief and Retirement Fund, and other members of the class had invested.

The Court upheld nearly all the claims, including claims for misrepresentations in WAMCO’s client brochures, scheme liability, and control person liability under Section 20(a) of the Securities Exchange Act of 1934. The Pomerantz team was led by Partner Omar Jafri, with support from Of Counsel Christopher Tourek and Associate Genc Arifi.

Thomas Perez is a prominent Dominican-American attorney and politician. Throughout his career, he has served as a prosecutor in the Civil Rights Division at the U.S. Department of Justice, as Assistant Attorney General for Civil Rights, and as U.S. Secretary of Labor. Under his leadership, the Department of Labor established critical measures to support workers, including expanding employment opportunities for workers with disabilities, ensuring fair overtime wages, and protecting retirement savings.

In 2002, he became the first Latino elected to the Montgomery County Council. He also serves as board president of CASA de Maryland, an organization supporting Latino and immigrant communities. Under his leadership, CASA de Maryland grew from a small church-based service provider to one of the largest immigrant advocacy groups in the mid-Atlantic.

Pomerantz has achieved a key victory in the Firm's securities fraud case against Ocugen, Inc., a biopharmaceutical company specializing in gene therapies.

The United States Court of Appeals for the Third Circuit reversed the District Court’s dismissal of the case on grounds that because there was no material and sustained stock price decline on one of the corrective disclosures, the misstatement could not be material.

The District Court relied on the Oran-Burlington rule in the Third Circuit, which held that in an efficient market, the absence of a significant and sustained stock price decline is evidence of immateriality. However, the Third Circuit’s decision explicitly abrogates the Oran-Burlington rule for materiality, finding it inconsistent with a flexible approach to materiality.

The case is led by Partner Brenda Szydlo with support from Associate Dean Ferrogari.
