Pomerantz has achieved final approval of a $172.5 million settlement for defrauded investors in a securities class action against Danaher Corporation., led by Partners Justin D. D'Aloia and Jeremy A. Lieberman. The Court granted all requests in full, including the motion to approve the settlement, making it the largest class action settlement achieved in the District of Columbia Circuit.

The case alleged that Danaher misled investors about the sustainability of demand for bioprocessing equipment as the COVID-19 pandemic subsided, leading to a share price drop when growth slowed.

Pomerantz has achieved a key victory in a securities class action against tax software company Avalara Inc., led by Partner Tamar A. Weinrib. On August 28, 2026, Judge Cartwright of the Western District of Washington granted Plaintiff’s motion to certify the case as a class action on behalf of Avalara investors who were eligible to vote on the company's acquisition by Vista Equity Partners. In so ruling, the Court rejected Defendants' challenges to typicality, adequacy, and predominance.

The suit alleges that Avalara and its Board issued a proxy statement containing materially false and misleading statements and omissions to solicit shareholder approval for Vista’s acquisition of the company at a $93.50 per share deal price. The class certification ruling is an impressive achievement that brings investors one step closer to holding Defendants accountable.

D'Aloia discusses a recent victory in a securities class action against Danaher Corporation, in which Pomerantz negotiated a $172.5 million settlement for damaged investors. The settlement represents the single largest recovery in a securities fraud case—class action or otherwise—in the D.C. Circuit since the enactment of the PSLRA in 1995.

Pomerantz has achieved final approval of a $55 million settlement for defrauded investors in a securities class action against SolarEdge Technologies, Inc., led by Partners Brian Calandra and Jeremy A. Lieberman.

The complaint alleged that SolarEdge and certain of its executives misled investors about the demand for the Company’s products in Europe and inventory levels of the Company’s products at European distributors. Plaintiffs alleged that the company engaged in “channel stuffing” by forcing distributors to take delivery of unneeded products to meet revenue targets, which artificially inflated reported revenues while masking declining demand and rising inventory levels.

Pomerantz has been named Co-Lead Counsel in a securities class action against Grocery Outlet Holding Corp., a U.S. retailer of consumables and fresh products.

The suit alleges that Grocery Outlet made misleading and overly optimistic statements about its Restructuring Plan, which aimed to improve long-term profitability and optimize store growth, which artificially inflated its stock price.

Despite publicly touting its strong Q2 2025 financial performance driven by rapid new store openings, on March 4th, 2026, the company announced disappointing financial results and the closing of 36 store locations due to rapid expansion. As a result, its stock price decreased by 27%, causing significant damages for investors.

Pomerantz has secured a significant win in the securities class action against Xiao-I Corporation, a global AI company. The Court denied Defendants’ motion to dismiss Plaintiff’s claims under Sections 11 and 15 of the Securities Act of 1933, allowing the case to advance.

Led by Partner Brenda Szydlo, with support from Associate Dean Ferrogari, the Court ruled that Plaintiff sufficiently pled the company omitted important information in its registration statement that was required to be disclosed under Rule 5-03 of SEC Regulation S-X.
