AI for nonprofits — the gains are real. So are the risks.

Nonprofit teams are stretched. AI can give a grant writer back five hours, a development director two more donor calls a week, a small ED a draft of the policy memo she would not otherwise write. Those gains are real.

The risks are too — and they fall in three buckets.

(1) Donor confidentiality. Putting donor names, gift amounts, or family details into a public AI tool can violate donor expectations and, in some states, donor-record privacy obligations.

(2) UBIT and operational scope. An AI-generated product or service the nonprofit sells may trigger unrelated business income tax — the rule does not change because the production cost went down.

(3) Mission drift. AI lowers the cost of doing things that look like the mission but are not — and a board has to be the one to notice.

Faraid and New York law — the elective share question.

New York gives a surviving spouse the right to claim the greater of $50,000 or one-third of the net estate. It is called the ""elective share."" It applies regardless of what your will says.

If a Faraid distribution gives a surviving spouse less than the elective share, the spouse can override the will. This is a critical conflict point between Faraid and US law that must be planned for in advance — not after.

The good news: with the right combination of lifetime gifts, beneficiary designations, and trust structures, this gap can often be bridged without dishonoring either tradition. The bad news: nobody finds this out at the wrong time except the family that did not plan.
