🤔Can a Landlord Use a Background Check?

The Fair Credit Reporting Act (FCRA) establishes rules to keep consumer information private and accurate. Accordingly, landlords must be aware of the rules under the FCRA the govern their use of consumer information in a background check.

☝️Landlords must certify to the background check company that they will use the background report for a "permissible purpose" (such as housing decisions related to applicants and tenants who apply to rent housing or renew a lease), and they will not use the consumer report for any other purpose. It is recommended that landlords get written permission from applicants or tenants to show that they have a permissible purpose.

❗️If a landlord plans to take any action that is unfavorable to the interests of a rental applicant or existing tenant (referred to as an "adverse action") based on a background check report, the FCRA requires the landlord to give an "adverse action notice" which must advise the applicant or existing tenant that the adverse action is being taken based on a background check report, as well as advise them of their rights to see information being reported about them and to correct inaccurate information.

Examples of "adverse actions" that require an "adverse action notice" include:

- Denying the rental application;
- Requiring a co-signer on the lease;
- Requiring a deposit that would not be required for another applicant;
- Requiring a larger deposit than might be required for another applicant; and
- Raising the rent to a higher amount than for another applicant.

🤔How Can an Employer Use a Background Check?

☝️ Employers are required to comply with federal law if they plan on using a background check to make an employment decision. Particularly, the Fair Credit Reporting Act (FCRA) and related laws have several requirements related to background checks that employers and background check companies must follow.

❗️ A background check company can be subject to the FCRA if it reviews and assembles consumer credit information in a report (commonly referred to as a “consumer report”) for a third party.

❗️ If an employer gets information from a company that is in the business of producing consumer reports, the FCRA requires the employer to give a written notice to the potential employee that the employer might use a consumer report for decisions related to the potential employee’s employment. This notice has to be “clear and conspicuous” and separate from the employment application.

❗️ Additionally, before obtaining the consumer report, an employer is required to obtain the potential employee’s written consent.
