The DIR issued a coverage determination regarding street sweeping in 2021, including the long-standing

We won - NYC Construction Safety Flaggers are owed Prevailing Wage! So happy that the New York Appellate Division unanimously affirmed Judge Borrok's Supreme Court decision holding that our certified class of 330 Judlau Construction Safety Flaggers working on public works projects were owed the full union Prevailing Wage. While Judlau billed the City of New York at rates close to $100/hr for each flagger, they paid the largely minority workers slightly more than minimum wage. The decision re-affirms New York's commitment to Prevailing Wages for all workers on government-funded public works projects. While Judlau called the Construction Safety Flaggers pedestrian crossing guards, arguing that they were not really a part of the construction crew, the Appellate Division rejected Judlau's semantics and reiterated that the Court must look to the nature of the work actually performed which was to protect the public and work crew from the inherent dangers of construction.

Pelton Graham LLC first started filing Construction Safety Flagger unpaid Prevailing Wage cases in 2015 and currently has over ten class action lawsuits pending against Con Edison and many of New York's largest public works construction companies. We believe the industry improperly withheld $100’s of Millions in wages that are owed to the largely minority Construction Safety Flaggers.

This is an enormous win for our firm and will help ensure that an entire classification of workers be paid a living wage for the difficult and dangerous duties performed on NYC roadways.
