In a New York DWI case, refusing a breath test can trigger penalties before the criminal case is resolved.

A first refusal can lead to a one-year license revocation and a $500 civil penalty. If you had another refusal or DWI/DUI within the past five years, the penalty can increase to an 18-month revocation and a $750 civil penalty.

Refusal can also be used as evidence in the criminal case. Saying no to the test does not make the charge go away.

In New Jersey, a DWI does not simply fall off your record after a few years.

A DWI can stay on your driving record for life. Unless legal action is taken, it can also remain on municipal court records permanently. It may affect your insurance for years, often around 3 to 5 years.

New Jersey’s 10-year step-down rule may help reduce how a later DWI is sentenced, but it does not erase the earlier one.
