What is the Visa Bulletin? Each month, the U.S. Department of State publishes cutoff dates that show where employment-based green card applicants stand in line. Congress limits how many green cards are issued each year, so employees wait, and their place in line is their priority date.

Why it matters for employers: the bulletin shows which sponsored employees can file their final green card application. Filing opens the door to work and travel permits and, after 180 days, more flexibility to change jobs. In November, dates moved forward for most countries, and U.S. Citizenship and Immigration Services (USCIS) is accepting the earlier filing chart.

The Labor Department has suspended PERM green card processing for eight employers, including Microsoft and Adobe. PERM stays open to everyone else, and the announcement did not revoke H-1B approvals or green cards.

The Department of Homeland Security (DHS) has proposed ending the policy that tells U.S. Citizenship and Immigration Services (USCIS) to give weight to a prior approval when an employer extends an H-1B, L-1, O-1, or TN worker. DHS projects about 6,044 more Requests for Evidence a year, and says each one adds about 64 days to a decision.

Two new immigration developments for employers.

The Department of Labor is suspending eight major employers from PERM, the first step of most employer-sponsored green card cases. The Department of Homeland Security has also proposed fees of up to $100,000 per student for Optional Practical Training (OPT). The OPT proposal is not in effect, and comments are due November 9.

A second federal court has blocked the $100,000 H-1B fee.

On September 30, a federal judge in California barred federal agencies from collecting the fee, including under the September 2026 proclamation that extended it. For now, employers can file H-1B petitions without the $100,000 payment.

The case is not over. The government can appeal, and a separate proposal for a $103,265 fee on cap-subject H-1B petitions is still pending.
