What happens if your 90 days on a K-1 fiancé visa are almost up and you’re still not married? 💍

Here’s something a lot of people don’t realize: You don’t have to file your green card application within those 90 days. But you DO need to be legally married!

And if you miss that deadline? Your green card process could get a lot more complicated, even if you marry your original K-1 sponsor.

📌 1️⃣ 90일은 언제부터 계산하나요?

비자 발급일이 아닌, 미국에 입국한 날부터 계산합니다.

📌 2️⃣ 90일 안에 I-485도 제출해야 하나요?

아니요! 90일 이내에 해야 하는 것은 법적인 혼인 성립입니다. I-485(영주권 신분조정 신청)는 반드시 90일 안에 제출해야 하는 것은 아닙니다.

📌 3️⃣ 90일이 지나서 결혼하면 어떻게 되나요?

K-1 체류기간은 연장할 수 없으며, 90일이 지나면 체류 신분에 문제가 생길 수 있습니다.

특히 원래 K-1 비자를 신청해 준 미국 시민권자와 90일 이후 결혼하는 경우에도 영주권 신청이 가능할 수 있지만, 절차가 복잡해지고 I-130이 추가로 필요할 수 있습니다.

⚠️ 중요한 건 결혼식 날짜가 아니라 법적으로 혼인이 성립한 날짜입니다!

💍 Planning to marry a U.S. citizen? Here’s what you need to know about the K-1 Fiancé Visa! 🇺🇸

The K-1 visa allows foreign nationals engaged to U.S. citizens to enter the United States for marriage.

But there are a few important things you should know! 👇

💌 1️⃣ You have 90 days to get married.
Once you enter the U.S. on a K-1 visa, you must marry your U.S. citizen petitioner within 90 days.

💚 2️⃣ Marriage doesn’t automatically give you a green card.
After getting married, you still need to apply for Adjustment of Status (Form I-485) to become a permanent resident.

📂 3️⃣ Keep your relationship evidence!
Photos, travel records, shared finances, and other documents can help support your immigration application.

One of the hardest parts of preparing a self-petition green card case?

Independent Letters.

For NIW and EB-1A cases, it’s not enough to simply say your work is important. USCIS may look for objective evidence showing that your achievements and impact are recognized beyond your own claims.

That’s where Independent Letters can help.

A letter from your boss, coworker, or someone who directly worked with you can still be valuable — but it may not carry the same level of independence as a letter from someone outside your immediate professional circle.

A strong Independent Letter should explain:

• How they know about your work
• Why your work or achievements matter
• What evidence they’re relying on to evaluate your impact

And no — having 10 recommendation letters doesn’t automatically make your case stronger.

It’s about having the right letters backed by the right evidence.

🚨 F-1 / J-1 D/S 규정, 시행 하루 전에 일단 중단됐습니다.

9월 15일부터 시행될 예정이었던 새 규정은 F-1·J-1 체류를 기존 D/S (Duration of Status) 방식에서 최대 4년의 고정 체류기간 방식으로 변경할 예정이었습니다.

하지만 9월 14일 연방법원이 예비적 금지명령(preliminary injunction)을 내리면서 새 규정의 시행이 현재 중단된 상태입니다.

현재 기준으로는:
✅ 기존 D/S 제도 유지
✅ 새로운 4년 고정 체류 규정은 시행되지 않음
✅ 이 규정 때문에 새로운 체류 연장 신청을 당장 할 필요는 없음

다만 이번 결정은 최종 판결이 아닙니다. 소송은 계속 진행 중이며, 향후 항소나 추가 법원 결정에 따라 상황이 다시 바뀔 수 있습니다.

🚨 The new F-1 / J-1 D/S rule has been blocked for now.. just one day before it was set to take effect.

The rule, scheduled to take effect on September 15, would have replaced the existing Duration of Status (D/S) framework with fixed admission periods of up to four years for F-1 and J-1 visa holders.

But on September 14, a federal judge issued a preliminary injunction, stopping the rule from taking effect for now.

As of today:
✅ The current D/S system remains in place
✅ The new 4-year fixed admission rule is not in effect
✅ There is no new extension requirement solely because of this rule

Importantly, this is not a final ruling. The lawsuit is still ongoing, and the situation could change through an appeal or future court decision.

Did the U.S. really stop ALL visas? 🇺🇸

Not exactly! and if you’re applying for a marriage green card, where your spouse is currently located matters.

If your spouse is outside the U.S. and going through consular processing, recent changes may affect interview scheduling at certain U.S. embassies.

If your spouse is already in the U.S. and filing for Adjustment of Status (I-485) through USCIS, this does not automatically mean your case has been stopped.

Immigration news can sound scary without context. Make sure you know what actually applies to your case.
