Matthew Aaron Ford, an attorney for Gentile, told Law360 via email that his team and client were "pleased with Judge Bloom's denial of the SEC's improper request for the issuance of an 'obey the law' injunction," referencing Judge Torres' finding that the SEC's request to enjoin Gentile from future violations of federal securities law would do "little more than order the defendant to obey the law."

Ford described the injunction denial as "part of a mounting judicial trend of declining to impose these unlawful restraints on liberty."

Two people who served as jurors on the defamation case, Nicola Barrett and Erica Christie, reached out to WOSU's Debbie Holmes. They say the disagree with the judge's ruling.

" I think Dr. Husel was used as a scapegoat and based on, NPR is what I believe reached out, they wanted to do a story regarding Dr. Heusel being, I think he was awarded or nominated for being Doctor of the Year and that story was killed by Trinity or Mount Carmel. So I think just the whole malicious...it just shows how malicious they were."

"I think at the point that the case was dismissed, there was credible, compelling evidence that was presented by the plaintiffs. And I think that they should have had an ample day in jury, a fair trial, and I think they were denied that given that the case was dismissed so early".

Ford O'Brien Landy LLP said that their client wants the yacht back, a potential problem for anyone who wants to buy the Amadea at auction for its advertised “world-cruising autonomy.” The U.S. government’s marketing for the yacht boasts that its “over 8,000 nautical miles of range and full helideck means Amadea is built to roam far beyond the typical seasonal ports.”

But a statement issued last week by a spokesman for Mr. Khudainatov’s lead lawyer in the case, Adam Ford, suggested that the vessel would not have a bright future if it were to venture into foreign waters.

“We doubt it will attract any rational buyer at fair market price because ownership can and will be challenged in courts outside the United States,” the statement said.

The Justice Department said the yacht, Amadea, was worth at least $300 million when it was seized in 2022 from a Russian oligarch. It’s unlikely to sell for that price.

“We doubt it will attract any rational buyer at fair market price, because ownership can, and will, be challenged in courts outside the United States, exposing purchasers to years of costly, uncertain litigation,” said Adam Ford, Partner at Ford O'Brien Landy LLP representing Khudainatov.
Adam Ford said Khudainatov would go after any proceeds from the sale of the yacht, estimated to be worth $325 million.
“Should the government press ahead simply to staunch the mounting costs it is imposing on the American taxpayer, we will pursue the sale proceeds, and any shortfall from fair market value, once we prevail in court,” Ford said.

The auction, which closes Sept. 10, comes as President Donald Trump seeks to increase pressure on Russian President Vladimir Putin to end the war.

Dr. Husel's complaint alleges that a calculated and knowingly false media campaign by Trinity Health Corporation and other defendants led to his indictment on 25 counts of murder on June 5, 2019. Prosecutors later dropped 11 counts, and Dr. Husel was acquitted of the remaining 14 counts on April 20, 2022.

The Franklin County Court of Common Pleas has ruled that Dr. William Husel's defamation lawsuit against Mount Carmel Health System to continue.

Adam Ford, a lawyer representing Khudainatov, said the ruling was “legally and factually flawed” and said he would appeal against it, challenging “any illegitimate sale or transfer through international legal channels”.

Sale of the $300mn Amadea is expected to move forward but cases that were not charged yet are likely to be abandoned
