New USCIS Policy Could Change How U Visa Holders Adjust Status!!!

Must watch full video for details and legal analysis: https://youtu.be/k-SUsAbtEYU

On November 2, 2025, USCIS released Policy Alert, confirming that a grant of U nonimmigrant status inside the U.S. is not an “admission” for purposes of adjustment under INA §245(a).

This update implements the Supreme Court’s decision in Sanchez v. Mayorkas (2021) and clarifies that U visa holders must seek adjustment under INA §245(m), not §245(a), unless they were admitted at a port of entry.

In this video, immigration attorney Muhammad Amir from Amir Law Firm explains

✅the key legal distinctions between §§245(a) and 245(m),
✅what this means for U visa holders, and
✅how USCIS adjudications will change moving forward.

In this video, immigration attorney Muhammad Amir from Amir Law Firm explains:

✅what the injunction means,
✅who it protects, and
✅what comes next.

Current Status:

• Annual asylum fee collection paused nationwide.
