🚨 BREAKING — August 13, 2026

The Board of Immigration Appeals just overruled 14 years of precedent. Traveling abroad on advance parole is now treated as a departure from the United States.

If you have accrued more than 180 days of unlawful presence, that trip can trigger a 3- or 10-year bar to a visa, readmission, or a green card.

Who should pause travel plans: • No lawful status but a pending adjustment of status with advance parole • Pending asylum applicants holding parole documents • DACA recipients • TPS holders with 180+ days of unlawful presence

The ruling applies prospectively only — travel before August 13, 2026 is not affected. A waiver may be available in limited circumstances.
