USCIS has issued a new policy alert that clarifies the eligibility requirements for citizenship for adopted children. Here are some of the key policy highlights:

-Certain adopted children who did not acquire U.S. citizenship at birth may be able to automatically acquire citizenship under INA 320, even if they are not residing in the U.S.
-The child must have been adopted by a U.S. citizen parent, and must have met certain requirements, such as having been lawfully admitted for permanent residence.
-The child must have lived in the legal and physical custody of the U.S. citizen parent for a specified period of time before turning 18.
-The new policy also explains eligibility for U.S. citizenship for adopted children who reside in the U.S. and how to obtain a Certificate of Citizenship, as well as those who reside outside of the U.S. and how to apply for citizenship and issuance of a certificate.
- Clarifies that a child may still apply for citizenship, depending on the circumstances, if the adoption is disrupted or dissolved.
