A Trump-appointed federal judge struck down last week the Biden Parole in Place program, which could have given over 500,000 undocumented spouses and stepchildren of U.S. citizens a pathway to applying for green cards without leaving the U.S.

BREAKING NEWS: A coalition of 16 states filed a lawsuit in the Eastern District of Texas seeking to stop the new Parole in Place Program for undocumented spouses and stepchildren of U.S. citizens.

The court has not yet decided on the states' request, so USCIS is still accepting new applications and processing those it has received. Unfortunately, the judge can issue an order to stop the parole program at any time. If you are ready to apply, consider submitting your case soon.

Texas Attorney General Ken Paxton led a coalition of 16 states and America First Legal to sue the U.S. Department of Homeland Security (“DHS”), Secretary Alejandro Mayorkas, and other Biden Administration officials.

Qualified spouses and stepchildren of US citizens under the Biden Parole-in-Place program can begin to submit applications on August 19 according to today's White House announcement.
