It is an honor and a privilege to stand with my clients in immigration court at a critical time in their lives. Today, we once again secured protection and justice for our client with a grant of asylum. It takes bravery and resilience to leave one’s home country and pursue a life free from fear. Congratulations to our client who is so deserving of the opportunities that await!

SIJ Case Approved!
Delighted to share the news with clients that their petition for Special Immigrant Juvenile Classification was just granted!

Special Immigrant Juvenile or “SIJ” Classification
Minor children who are presently in the United States and who have been abused, abandoned or neglected by one or both parents may be eligible for Special Immigrant Juvenile (“SIJ”) classification.
SIJ classification is usually a several step process. First, a court order must be obtained with a finding that includes that the minor (aged under 18 or 21 years old, depending on the State where the minor resides) was abused, abandoned or neglected by one or both parents and that it is not in the minor’s best interests to return to their country of nationality or last habitual residence with the parent(s).
After a state court issues the order, the next step is to petition USCIS for SIJ Classification. The request is filed using USCIS Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.
Once SIJ classification is granted by USCIS, the minor may qualify for lawful permanent residency (also known as getting a Green Card) by applying for Lawful Permanent Resident (“LPR”) status using USCIS Form I-485, Application to Register Permanent Residence or Adjust Status. Depending on the circumstances, adjustment of status might be filed at the same time as the SIJ petition. If an immigrant visa is immediately available, you may generally file your Form I-360 and Form I-485 at the same time. Immigrant visas for SIJs come from the employment-based fourth preference (EB-4) immigrant visa category for special immigrants. If an immigrant visa is not available, Form I-360 is filed on its own, but Form I-485 will need to wait to be filed later.

We are proud to announce that Alina Kaganovsky successfully secured a grant of asylum representing her clients in Immigration Court. Most notably, on the day of the trial, the DHS attorney did not object to our evidence and did not oppose a grant of asylum. The hearing was over within 15 minutes without the need for the clients' testimony. Congratulations to another family on the path to U.S. citizenship!

update from

DHS directs USCIS, ICE and CBP to review and reset enforcement policies and set interim policies for civil enforcement while DHS develops their final priorities.

For 100 days, starting January 22, 2021, DHS will pause removals for certain noncitizens ordered deported to ensure we have a fair and effective immigration enforcement system focused on protecting national security, border security, and public safety.
