Congratulations to Nathan Shook on his recent defense verdict in Dutchess County!
Nathan represented a dentist in a case where the plaintiff, a large national dental company, claimed that the defendant breached the sale agreement for the purchase of his practice. The plaintiff claimed the dentist had wrongfully withheld medical information during the contract negotiations and that he should not have left the practice following the sale. The plaintiff sought damages that nearly totaled the sale price of the practice.
Nathan was able to prove that the contract documents did not require the dentist to remain working at the practice and that he could leave or be terminated at any time. It was also proven that the plaintiff had sufficient knowledge of the dentist’s health such that the onus was on the plaintiff to investigate or make further inquiries.
Nathan and his expert were able to prove plaintiff’s damages expert made incorrect assumptions about the value of the practice and effects of the dentist’s retirement on the alleged loss of business and that their overall methodology and use of EBITDA was not a true measure of damages.

Congratulations to Craig A. Burgess on his recent defense verdict in Dutchess County! Craig represented a urologist in a case where the plaintiff claimed the physician improperly performed a cystoscopy dilatation and placement of a Foley catheter resulting in a re**al injury. The plaintiff claimed the doctor failed to identify anatomical landmarks and used excessive force in placing the dilators and catheter causing a direct injury to the re**um. Plaintiff claimed the physician never entered the bladder but instead caused a perforation to the re**um. As a result, plaintiff claimed he needed a colostomy, placement of suprapubic tube and wound vac and warranted reversal surgeries.
Craig was able to prove the patient’s prior prostatectomy with surgical clip placement which had migrated into the bladder neck, resulted in augmented anatomy that impacted the placement of the instrumentation.
Craig and his expert were able to use both CT findings and PVR studies to prove the proper placement into the bladder and that the injury was not caused by medical malpractice.

Congratulations to Craig Burgess and Edward Kealy on their recent defense verdict! Craig and Ed represented a nurse practitioner and family practice physician in this wrongful death action. Plaintiff alleged the decedent was improperly prescribed a medication to address insomnia and adjustment anxiety and was not informed regarding the risk associated with the use of that medication. Plaintiff claimed the decedent committed su***de via the injestion of Drano as a result of the use of that medication. While each side produced experts in the field of medicine and toxicology, Ed and Craig were able to convince the jury that the medicine choice was appropriate and that the toxicology failed to prove the medicine was injested at the timeframe at issue.
After a 10 day trial the jury returned a verdict for the defendants. This was the second defense verdict in a month for Craig Burgess!

Congratulations to Edward Kealy and Marsha Weiss on their recent appellate victory on behalf of their hosptial client. Ed and Marsha successfully opposed plaintiff’s appeal of the lower courts granting of their pre Answer motion to dismiss the Complaint. After the oral arguments the 2nd Department affirmed the Supreme Court decision. Aggressive motion practice and well written and argued appeals resulted in a fantastic outcome for the client and carrier.
