🍦πŸ₯€ Yesterday was National Root Beer Float Day, so you know we had to bring the tradition into the office to close out the week!

There is nothing better than a classic summer treat to thank our incredible staff and attorneys for all their hard work. It was the perfect afternoon break to swap stories and share a few laughs before heading into the weekend. Kate and Mackenzie even brought some floats to the city crew working outside our office yesterday.

Mackenzie delivered an insightful session focusing on Wisconsin insurance bad faith claims. In Wisconsin, insurance carriers owe a strict obligation to their policyholders. When an insurer fails to meet those standards, whether through intentional delays, failing to conduct a reasonable investigation, or refusing to pay an undisputed amount in a timely manner, the policyholder may have a claim for bad faith.

As Mackenzie highlighted, bad faith claims allow policyholders to pursue additional compensatory and, in certain cases, punitive damages to hold non-compliant carriers accountable.

When we talk about maximizing your compensation after an accident, it’s not just about the settlement you reach with the at-fault driver. It’s also about defending your settlement against health insurance companies.

We recently settled a case for the absolute maximum policy limit of $500,000. But the client's health insurance company had paid $400,000 in medical bills, and their policy explicitly stated they were entitled to dollar-for-dollar reimbursement. Most drivers know they need to shift lanes or slow down for police cruisers, ambulances, and tow trucks on the shoulder. However, under the updated Wisconsin Act 54, that protection now strictly extends to any disabled vehicle on the side of the road displaying hazard lights, emergency flares, or visible signs of distress.

Whether someone is changing a flat tire on the way to the lake or waiting for a tow, state law requires passing drivers to safely clear the adjacent lane or drop their speed significantly if a lane change isn't possible.
